—THAT the provisions of Chapter III, Article. 6, Subsection 10.2
be amended as follows:
10.2 Any person accused of a violation of this article which
prohibits parking in a duly marked or posted no parking
area, double parking, parking n a fire hydrant, parking
on public way or other publiceland for a continuous
period exceeding 24 hours, parking so as to interfere
with snow removal or plowing, or parking on a sidewalk
or esplanade, may voluntarily waive his or her right to
appear and defend before any court or judicial tribunal
the charge made against him or her for such illegal
parking by paying to the municipality

THAT the provisions of Chapter III, Article 6, Subsection 10.3
be amended as follows:
10.3 Any person accused of a violation of any portion of
this ordinance which prohibits illegal night parking,

THAT the provisions of Chapter IIID Article 6, Subsection 10.4
be amended and redesignated as Subsection 10.5, as follows:
10.5 Any person accused of aviolation of any portion of this
Article other than those violations specified in subsections
10.1, 10.2 and, 10.3, and 10.4 above may voluntarily
waive his or her right to appear and defend before any
Court or judicial tribunal the charge made against him
r her for such .illegal parking by paying to the
municipality the sum of five dollars ($5.00) within €€ve
th'xt ((30) days of the time such alleged offense was
committed.
THAT the provisions of Chapter III, Article 6, Subsection 10.5
be amended and redesignated as Subsection 10.6, as follows:
10.6 Members of the Police Department are hereby authorized
to refrain from instituting prosecution for the alleged
offense for a period of €€ve-t5} th'rt (30) days from
the time such alleged offense was comm tte .
THAT the provisions of Chapter III, Article 6, Subsections
6.4 and 6.5 be repealed.
Statement of Fact: The purpose of this Ordinance is to reduce the
Iver fee for parking violations in off-street permit parking areas
from $5 to $3 a recently recommended by the Down Town Parking
Advisory Committee. This proposal is also intended to .clarify the
right of violators to pay waiver fees for a period of 3o days after
the date the ticket was issued in accordance with existing policy
and to eliminate conflicting and unnecessary provisions in the City's
parking ordinance.
