Jordan, Consulting Begineers - Industrial Pretreatment By the City Coaact of W My Of Deaver: ORDERED, THAT, WHEREAS, the City of Bangor has previously entered into a Professional Services Agreement with E. C. Jordan Company of Portland, said Agreement dated December 21, 1979, for preliminary Planning and the evaluation of alternatives for secondary sewage treatment, and WHEREAS, the Environmental Protection Agency now requires the development of an industrial pretreatment program in accordance with EPA Regulation 40 CFE 403, and WHEREAS, the State of Maine Department of Environmental Protection has approved an Amendment to Bangor's existing grant. Agreement to cover the cost of industrial pretreatment study, and requires an executed Agreement with the Consulting Engineer, NOW, THEREPODE, Be It ORDERED, THAT the City Manager, acting for and on behalf of the Municipal Officers, be and hereby is authorized to enter into the attached Amendment No. 1 to the above-mentioned Professional Services Agreement pertaining to the development of an industrial pretreatment program. STATEMENT OF FACT: The total estimated cost of the proposed additional work is $129000.009 consisting of $10,000.00 for the CousultinC Engineer's services, and $2,000.00 for administration. Seventy-five percent of the cost will be paid by the Federal Government, $1,800.00 by the State of Maine, and $1,200.00 by the City of Bangor. Funding of the local share is already available in Account No. 52-60-20 (3038). Professional Services Agreement between the CITY OF HANGUR, MAINE and the E.C. JOROON Co. ARTICLE I PURPOSE This Amendment made this day of in the year Nineteen Hundred Eighty -Three re the existing Agreemeat by and between the City of Bangor, Maine (OWNER), and the E.C. Jordan Co. (ENGINEER), has been prepared to modify the existing Agreement to reflect the following changes in project scope: - 1. Prepare an industrialpretreatment.management program for the CSYT of Banner in accordance with the EPA regulation 40 CFR 403. , ARTICLE II - CHANGES TO THE SCOPE OF SERVICES As a result of the change in project scope outlined in Article I, the ENGI- NEER'S scope of services is hereby amended to provide'tbe following additional services. - The ENGINEER will Prepare an Industrial Pretreatment Hamegement -Program for the City of Sanger. The Pretreatment Program will be prepared In accordance with EPA regulation 40 CPR part 403, dated June 26, 1979 and will consist of the following elements: 1. The ENGINEER will prepare for distribution by the CITY an Industrial User Suroey Questionnaire. - The CITY will: o Distribute the Questionnaire to the Industries In Seeger and the Tawe of Hampden. o Follow up on non -responders to the Questionnaire by telephone. There will be no sampling or testing of wastes. COgTR&U NO. 1058-00 2 - DIA.8.8.83.1 Based on the results of the survey, the ENGINEER will: a. charactererize and estimate the volume of the pollutants contri- buted to system; b. identify industries subject to the categorical national pro - treatment standards; C. identify industries with wastes not covered by Item lb, but which may pose operational problems at the Bangor treatment _. plant d review and incorporate available existing data; and a. tabulate summary of industries, wastewater flow estimates and characteristics.. Y. Provide engineering assistance in the evaluation of legal authorit necessary for the CI1Y to monitor and enforce the pretreatment y PzoBre-m. a. Review sewer ordinance, local, stateand federal statutes, agree - meats, Or Other germane legal authority. b. Recommend revisions to the city's sewer Ordinance and agreement with Revision ifnec sa, to enable the CIIT to monitor and enforce the . pre program. NOR: Consultation, review and input from the city attorney will be necessary to complete this Stem. 9. Revise Barger treatment plant design with respect to tolerance to polls - tents which may interfere with its operation. 6. Develop a monitoring affi enforcement program to accomplish the follwing: a notiify etinduustries of specific categorical or Prohibited discharge limb. re®9ve and analyze reports required of industries by program reguls- C. develop sampling and monitoring programs and schedules; d. develop non-compliance tracking procedures; e. develop annual report format on violations; f. determine required monitoring equipment needed for the treatment works; d CONTRACT NO. 1058-00 3 DLA.B.8.83.1 g. estimate construction and equipment required for CITY to conduct Industrial sampling and monitoring. - 5.- Estimate capital aM operating costs required toace mplish the progrea. a. Establish public participation procedures. - - e. prior to submitting the program for approval, three informal public _ meetings will be conducted in compliance with EPA regulation Title. 40, Part 403.9, (6) (3) (d). - ARTICLE III COMPENSATION With the addition of services as identified above, plus direct expenses as shown on the attached EPA Form 5700-41, this Amendment revises the compensation in the existing Agreement to a lump a= of ten thousand ($10,000) for the rices described above and identified in Item III D in Attachment A. Work program, of the December 21, 1979 existing Agreement. - All other provisions of the existing Agreement remain in effect for this Amendment.
