ORDERED,
THAT. the City Manager be and hereby is authorized an behalf
of the Municipal Officers to sign the attached Memorandum of Under-
standing with the Maine Department of Transportation for Federal
Aid Project No. M-1590(1), involving the paving of Outer Hammond
Street southeasterly from the Hermon Town Lino for a distance of
approximately 0.4 miles; and be it further
ORDERED,
THAT the sum of Five Thousand Dollars ($51000.00) be allocated
from Account No. 92-2235, Reserve Ior Future Construction - Gameral,
to cover the City's share of the cost.

Whereas the subject project hes been included in the Capital investment
Program, contingent on local cost sharing, it is necessary for the city of
Sensor, hereinafter referral to as the Municipality, and the Maine Dape-tmahc
of Transportation, hereinafter referred to as the Department, to agree to a
project coordination snd reivbo cement procedure.
The Mhnfcipality must indicate their conourrece in these co®itmencs, ae
outlined, by signing the original of the MemranAmn in the spaces provided and
raw= it to the Maine Department of Transportation, State House Static 160
Augusta; Maine 04333, Attn: Richard A. Coleman, Cnief Itrginaer. This signed
dochmiant must be received prior to the beginning or continuation of
preliminary engineering activities.
A. Definitions
1. Progreamed coat
Tne"'ry rased cost of a project is the estimated coat
as slave in the Department's Capital Investment program.
Tthe program d cost of this project is $24,828. This
amount is for planning purposes only, since it is based
upon Preliminary infoxmatlnn. Tle project development
process will refine this figure using more detailed
information ant will provide the "total estimated cast"
to be used as a basis Ear the 'Tthntcipal Share."
2. Total Estimated Cost
The total estimated cwt of a project is the estimated
cost at the completion of cbe pmjmt development pro-
cess, including the cost of engineering, right-ofw ,
ccvettuctiw, and other items considered necessary to
satisfactorily complete the project. This amount will
be the basis for determining the 'Timicipal Share" of
Project cost.
3. Muadcipal Share
The P icipal 9 represents the portion of the total
estimated cost of a project to be amde available by the
Municipality. The Municipal Share of the subject project
is 20% of thatportion of the project within dva urbsn
Compost Arm.
R. Reis semen:
1. Prior to the beginning or contiuuaticn of the project dev-
elopment process, the Municipality will forwani a signed
copy of this M ranfi®. ]his will acl mledge that the
level of the Municipal financial obligation tawarri this
project hulicetad above is acceptable.
2. At the completion of project design and right-of-way
appraisal the Department All notify the M icipelity of
the "total estimated cost" of the project which is to ba
the basis of the payment �ted from the M icipality.
This noeiflcatim will be contained wlthlo a Municipal/
State Agxeevent or will be by letter if no Agreement is
r ired for this project.
3. Dur omrent schedule calls for advertising this project in
the spris , 1995. The cmrws ctim contract will be
swan several weeks (usually three) after admartising
for bids. The Municipal Share will be required at that
time. Should the total estimatul cost of the project as a
result of contract award be different than de 'Total
Estimated Coat;' which determined the 'hmicipal Share;'
then the Municipality will be responsible only for their
proKata share of the lesser amimt.
4. The total £hmrcial obligation of the Municipality toward
this project will be coapleted with the action required by
Paragraph 3. above, mless significant cba ges in project
scope during cme[tucam initiated by the l cipality
result in an increase in the 'Total Pstlasnsd Cost." In
which rase, the Mmicipality is expected to pay the entire
non feral portion of the increased coat.
C. Project reyelepmeat
1. lM Department, filing the project public participation pro-
cess, will arrange for a meeting witr Cha officials of the
Municipality, if desired by the Municipality, to review the
project limits, scope of soak, etc., based on Che best Infor-
mation available at chat time.
2. Additional reviews my be requested by either tle Mmicipal-
ity or the Department at any polar in the project development
preCea6. _
3. A M®icipal/State Agreement may be prepered by the State
formalizing the fading and will outline Cie soak to be done
by the State and that whirlr is to be perforaesl by the
Mntcipality. If the project's simplicity does not warrant
an Agretment, then a letter All be developed irdicating the
amount of the'Mmicipal share."
4. The Municipality and Che Department retain the right to term-
Lmte the project at any ties prior to the actual acquisition
of rightofv . Projects cannot be by the Muni-
cipality subsequent to rightof-say acquisition without con-
currence by the Department.

The Municipality and the Department will share
proportionately, as with total project fund-
ing, in the responsibility for Che rah -federal
share of Cha total expo dituxes incurred
against Che project at the time of termination.
Tole becomes effective upon signature.
