ORDERED,
THAT WHEREAS, considerable flooding of the northerly portion
of Saratoga Avenue and Glencove Avenue has been experienced during
periods of heavy rain, causing the overflow of storm sewers and
subsequent damage to street surfaces, and
WHEREAS, it has been determined that the cause of the street
flooding is a large quantity of surface water entering into the
Woodlawn.Subdivision area from properties located to the north,
and
WHEREAS, it has been determined that the excessive storm water
accumulation on Saratoga Avenue and Glencove Avenue can be relieved
by constructing a diversion ditch on land located to the north of
the Woodlawn Subdivision, extending in an easterly direction to an
existing drainage ditch flowing toward Mount Hope Avenue, and
WHEREAS, public exigency requires the immediate acquisition
of drainage easements to permit the installation and maintenance
of a drainage ditch prior to the coming winter season,
NOW, THEREFORE, Be It
ORDERED, THAT the City Engineer, acting for and on behalf of
the Municipal Officers according to �aw, be and hereby is authorized
to lay out and establish easements for the proposed drainage ditch
where it crosses private property located north and east of the
Woodlawn Subdivision, the location of the centerline of said ditch
more fully described as follows:
Land owned by Sylvania Electronic Products, Inc., described
in Polishco Re i t of Deed Vol. P e
Beginning at a point on the westerly property line of said
Sylvania land, said point being 40 feet north from the southerly
line of said land, as measured at right angles from said southerly
property line; thence in an easterly direction along a line parallel

to and 40 feet north from said southerly property line for a
distance of 990 feet; thence deflecting 45 to the right of the
last described line and proceeding in a southeasterly direction
for a distance of 56 feet, more or less, to the southerly property
line of Sylvania, being the northerly property line of land owned
by Bangor Convalescent Center Realty Trust.

described in Penobscot Registry of Deeds, Vol. 3365,
Pace 105:
Beginning at a point on the northerly line of said land of
Bangor Coavaleaceat Center Realty Trust, located 40 Peet, more or
less, east from the northwesterly corner 8f said land; thence in a.
southeasterly direction at an angle of 45 with said northerly
line for a distance of 400 feet, more or leas, to an existing
drainage swale; thence continuing in a generally southeasterly
direction and following said swale for a distance of 300 feet,
more or less, to the easterly property line of the Bangor Convales-
cent Center Realty Trust at a point located 550 feet, more or less,
south from the northeasterly corner of said lend, as measured along
said easterly property line.
Said easement is to be laid out to a width of 20 feet,
.measuring 10 feet on either side of, and at right angles to,
the above-described line.
The purpose of said easement is to permit the City of Bangor
or its agents to enter upon the above-described properties as
necessary to construct and maintain an open drainage ditch within
said easement area, including clearing, grubbing, grading, leasing
and seeding of the ditch area for the purpose of intercepting surface
water and diverting its flow in an easterly. direction to an existing
drainage course. And be it further
ORDERED, THAT the City Engineer proceed to give notice of such
intention of said Municiyal Officers according to law by posting
such notices for seven (7) days in two (2) public places in the
City of Bangor and in the vicinity of the proposed drainage ditch,
and the City Engineer is further
ORDERED, TO make a written .return of said proceedings am-
taining the bounds and admeesurements of said easements and the
damages allowed to any parson or persons as a result of said
laying out, all in accordance with the laws of the State of Maine.
