THAT the City Manager, on behalf of the City. of Bangor, i hereby authorized to execute a Municipal Quitclaim Deed in favor of 1912 Associates Development Corporation, a copyof said Deed being on file in the Office of the City Clerk, STATEMENT OF FACT: By deed dated May 25, 1931,,r,corded in the Penobscot County of Deeds in..Volume 1054, Page, 127, the City of Bangor conveyed three parcels of.land to Mellen C. Pierce, Hayford Pierce, Ada Pierce. McCormick, and. Merchants National .Bank of Bangor (Trustee of.Waldo. Pierce), predecessors in interest to. 1912 Associates Development Corporation. The description: of thesecondparcel in said deed utilized the bank of the Kenduskeag Stream as a reference point, as opposed to the stream itself. P,cparty tocated At ou or Abt 112 Fr'm' 8txeet - Introd �nd ed by ..... ... .. 83-277 THE INHABITANTS OF THE CITY OF BANGOR, a Municipal Corporation, with a place of business at Bangor, Penobscot County, Maine, for consideration paid, release to 1912 ASSOCIATES DEVELOPMENT CORPORATION, a Maine corporation with aplace of business at 115 Franklin Street, Bangor, Maine, the following described real estate, to wit: A certain lot or parcel of land with the improvements thereon, situate in the City of Bangor, County of Penobscot, State of Maine, more particularly described as follows: - Beginning at a point on the northwesterly sideline of Franklin Street in said Bangor, where said street line intersects the easterly wharf line of Kenduskeag Stream as said wharf line i described in a deed from the City of Bangor to Mellen C. Peirce, at al, recorded in Penobscot Registry of Deeds, Volume 1054, Page 127, which point is defined as being North e degree thirty-one minutes thirty seconds East (N 10 31' 30" E) adistance of fifty-nine and eighty-nine hundredths feet (59.89') from a brass disk set in the pier of the Franklin Street bridge across said stream; thence North nine degrees fifty-six minutes thirty seconds West (N 90 56' 30" W) by and - along the westerly line of Franklin Street, a distance of thirty-eight and fifty-seven hundredths feet (38.57') to a point of curve, thence northeasterly by and along said Franklin Street following a curve to the right having a radius of one hundred thirty-six and zero hundredths feet (136.00'), an arc distance of eighty-six and seventy-six hundredths feet (86.761) to a point; thence North fifty-two degrees thirty minutes forty seconds West (N 520 30' 40" W) parallel to and five tenths feet (0.5') northerly from the northerly face of the building on the lot herein described, a distance of sixty-six and thirty-three hundredths feet (66.33') to a point; thence South thirty-seven degrees twenty-seven minutes zero seconds West (S 370 27' 00" W) by and along a line parallel to and five tenths feet (0.51) westerly of_the-westarly,-faoe-®€-- -- ----- said building, a distance of one hundred sixty-five and zero hundredths feet (165.00') to a Point which is North fifty-seven degrees fifty minutes five seconds West (N 570 50' 05" W) a distance of one hundred seventy-two and nine hundredths feet (172.091) from the aforementioned brass disk set in the pier of the Franklin Street bridge; thence continuing on the same course (S 37. 27' 00" W), a distance of five feet (5'), more or less, to low water line of Kenduskeag Stream; thence southeasterly and easterly by and along low water line of said stream, a distance of one hundred fifty-five feet (155'), more or less, to the point of beginning, enclosing fifteen thousand two hundred (15,200) square feet. The purpose of this deed is to establish the division line between lands of the Grantee herein and the land described in deed to the City of Bangor from Moses Giddings, dated March 6, 1084, recorded in said Registry, Volume 545, Page 426, and a deed to the City of Bangor from James C. Fargo as President of the American Express Company, dated August 2, 1912, recorded in said Registry, Volume 032, Page 271. It is expressly understood that this deed shall include all interest which the Grantor may have in and to that area between the "bank" and low water mark of Aenduskeag Stream on the southwesterly extension of the northwesterly and southeasterly boundaries of the Second Parcel of a deed from the City of Bangor to Mellen C. Peirce, et al, dated May 25, 1931, recorded in said Registry, Volume 1054, Page 127. Bearings referenced herein are calculated from a traverse oriented to true north established a for a survey of the within described lot by Plisga6rOay, Land Surveyors. Any and all other rights, easements, privileges and appurtenances belonging to the granted estate are hereby conveyed. The Inhabitants of the City of Bangor have caused this instrument to be signed and sealed in its corporate name by John W. Flynn, its City Manager, thereunto duly authorized, this day of July, 1983.
