- Space on City's Waterfront Bulkhead
This Order will authorize execution of a Supplemental agreement to renew a lease between the
United States Coast Guard and the City for use of the City’s docks. The renewal is for one year,
October 1, 2019 through September 30, 2020 with the option for ten annual one-year renewals
through September 30, 2029.
Since 2007 the City has leased space on the City docks for the use of the Coast Guard ice breakers
during those times when the ice breakers are opening waterways in and around the Bangor area.
The lease has been renewed annually.

Be it Ordered by the City Council of the City of Bangor that, the City Manager is hereby authorized, on behalf
of the City of Bangor, to execute a Supplemental Agreement No. 8, amending the lease by and between the
City of Bangor and the United States Coast Guard dated October 1, 2007 for space on the City's waterfront
bulkhead on the Penobscot River. Said Supplemental Agreement No. 8 shall be in a form substantially as
attached hereto and in a final form as approved by the City Solicitor or Assistant City Solicitor.

Hereinafter called the Lessor, and the UNITED STATES OFAMERICA, hereinafter called the Government:
WHEREAS, the parties hereto desire toamend the above Lease.
NOW THEREFORE, these parties for the considerations hereinafter mentioned covenant and agree that the said Lease is
amended, effective 01OCT19 as follows:
The Government does extend the said agreement and all conditions thereof, for the period 01 October 2019 to 30 September
2020. The Government's obligation hereunder is contingent upon the availability of appropriated funds from which paymentfor the
contract purposes can hemade. No legal liability on the part of the Government for payment of any money shall arise unless and
until funds are made available tothe realty specialist for this procurement, You will benotified immediately iffunds donot become
available for this procurement.
]) The Government shall pay annual consideration of $ 1.00 paid annually in arrears on or about the last day ill September.
2) The parties agree to an OPTION clause to be added to the agreement, for the annual renewal for ten (10) one-
yearhannafo||owing this renewal, through Sept 30. 2029. Although the lessor need not sign the future
Supplemental Agreement, the Lessor is still responsible to update their account on www,SAM.gov annually so
as not to interrupt annual payments.
All other terms and conditions of the lease and supplemental lease agreements shall remain in force and effect.
