WHEREAS, by Quitclaim Deed, dated. October 8, 1970,the Cdty of.
Bangor acquired from the United States of America three (3) schools,
and land appurtenant thereto, namely: Union Street Junior High
School, Dow Lane School, and Downcast Elementary School; and
WHEREAS, said conveyance was conditioned upon the use by the
City of Bangor of said schools for "educationalpurposes" in
accordance with a proposed program and plan previously submitted
by the City of Bangor; and
WHEREAS, after a series of public meetings, including two (2)
public hearings, the Bangor School Committee voted on December 6,
1982, to direct the Superintendent of Schools to advise the Bangor
City Councilthatthe buildings housing the Dow Lane School and
the Union Street Junior High school, and land appurtenant thereto,
are no longer required foreducational purposes by the Bangor
School Department, effective July 1, 1983, -
NOW, THEREFORE, By the City Council of the City of Bangor:
RESOLVED,
THAT the City of Bangor can no longer utilize the buildings
commonly known as the Union street Junior High School and Dow Diane
School, and land appurtenant thereto, as marked on a plan entitled
"Site Plan, Union St. Recreational Park", dated September 14, 1918,
on file with the City Clerk; and be it further
RESOLVED,
THAT the City of Bangor currently holds title to said buildings
and land; and has the authority and wishes to return title to said
buildings and land to the United States of America; and be it further
RESOLVED,
THAT the City of Bangor plans for the indefinite future to
utilize the adjacent athletic fields, central parking lot and access
road, as marked on said Plan, for educational purposes; and be it
further
RESOLVED,
THAT John W. Flynn, City Manager, is hereby authorized and
directed to execute all documents and to do any and all things
necessary to return said Union Street Junior High School and
Dow Lane School, and land appurtenant thereto, retaining for
the City of Bangor title to said adjacent athletic fields,
central parking area and access road; and be it further
RESOLVED,
THAT John W. Flynn, City Manager, is hereby authorized and
directed to execute such agreements, easements, or other doeu;rtents
s may be approved by the School Committee providingfor joint
use of said parking lot and access road by I& United ,States of
America, or its successors in title to said schools and appurtenant
land, under such conditions as will protect the rights of the
City Of Bangor and users of said athletic fields to use said
parking lot and access road for educational purposes; and be it
further
RESOLVED,
THAT. the City of Bangor, by its City Council', understands
and agrees that it will take all reasonable steps to maintain.
and protect said Union Street Junior High School and said POW.,,
Lane School, and land appurtenant thereto, until title thereto is
accepted by the United States of America.
