ORDERED, _ THAT WHEREAS, pursuant to Council Order 83-96 adopted on February 28, 1983, the City, of Bangor and Bangor Maine Associates entered into a Lease Agreement on March 1,. 1983. relative to certain parking spaces located in the downtown area; and WHEREAS, said Agreement called for the rental of ten parking spaces in the Columbia -Hammond Street Parking Deck by Bangor Maine Associates commencing on July 1, 1983; and - WHEREAS, Bangor Maine Associates is desirous of amending said Agreement to provide for the rental of three deck parking spaces as of July 1, 1983 and rental of the remaining seven deck parking spaces as of January 1, 1984. Www on^.^:«: 'Ark Of.. ux.oBNa % N�0 53a N EXHIBIT A CITY OF BANGOR FINAL STATEMENT OF - COMMONITY DEVELOPMENT OBJECTIVES BY 1983 The primary objective of the City of Bangor Community Develop- ment Program is the development of a viable urban community by providing decent housing, a suitable living environment and expanding economic opportunities, principally for persons of low- and moderate - income. Consistent with this primary objective, Bangor's BY 1983 program year specific objectives and projected use of funds are. 1. West Side Neighborhood Conservation Prefect To arrest and eliminate blighted and deteriorated housing conditions and to bring about animprovement in the neighborhood environment in the area generally bounded by Second, Cedar, Sanford, Chester Place, Third, Union, Highland Court, Ohio, Kossuth, Aenduskeag Stream, Court, Hammond, Clinton, Dole Court and Union Streets by under- taking neighborhood Conservation activities involving concentrated code enforcement; a housing rehabilitation financial and technical assistance program, principally for the benefit of low- and moderate -income persona; selective acquisition and clearance of severely deteri- orated and/or inappropriately developed properties; relocation assistance to displaced persons and/or busi- sdisposition of -acquired properties; and improve- entsto public streets, sidewalks, esplanades, street lighting and recreation areas. Of the City's $1,077,000 FY 1983 Community Development Block Grant (CDBG) Entitle- ment Funds, approximately $703,707 will fund the second year increment of this approximate $1,300,000 multi-year project[ 2. Downtown Revitalization Activities To alleviate physical and economic distress through stimulation of private investment, community revitalization, expansion of economic opportunities, and aiding in the elimination of blighting influences by providing financial and technical assistance for the rehabilitation, restoration, reuse, and/or expanded use of existing private properties; Page 2 construction, reconstruction, rehabilitation and installation of publicly owned facilities; promoting and assisting new private development of vacant and underutilized property; preventing and eliminating blighting influences through code enforcement and, as necessary, selective acquisition and clearance orrehabilitation of vacant and/or deteriorated properties; assisting the development of the recreational, j residential and commercial potential of the waterfront and stream areas; and implementing the City's strategy for down taw revitalization. it is projected that $232,310 of FY 1983 CDBG Entitlement Funds will be used to provide public improvements and/or financial assistance to leverage the private investment necessary to restore, rehabilitate, repair, reuse and beautify existing buildings. 3. Alleviation Of Imminent Threats to Health and Safe[ To correct and eliminate sudden and unexpected threats to the health, safety and welfare of the citizens of Bangor, when no other financial r ailable to meet such needs, by Carrying out eligible Community Development activities as necessary to alleviate the threat. 4. Loans £or Property Rehabilitation in C h Federal Rent Subsidies To improve and expand housing opportunities for low- and moderate -income persons by making available, on a City-wide basis, low-interest rate property rehabilitation loans to owners of axisting properties who commit themselves to participate i n available federally or state funded and omitted rent and/or rehabilitation subsidy program such as the Section 8 Moderate Rehabilitation, Section 8 Existing Housing, and Rental Rehabilitation Demonstration programs. Eligible properties are those which do not currently meet HUD Section 8 Minimum Property Standards end/or the City Of Bangor's Property Maintenance Code, but which can economically be brought into compliance. Rehabilitation will be limited t0 cozzecting Code violations and/or violations of Section 8 Minimum Property Standards, cost effective energy conservation general property improvements necessary to put the property into generally goad and readily maintainable condition and the conversion of an existing structure to housing or to increase the number of dwelling units in an existing residential or mixed-use structure. Page 3 PROJECTED USE OF FUNDS The projected use of Bangor's FY 1983 Community Development Block Grant Entitlement Funds is as follows: Downtown West Side Revitalization NCP Area Acquisition of Real Property $- 51,945 Disposition of Real Property 9,689 $ 5,000 Public Improvements 272,186 47,310 Clearance, demolition, and removal of buildings and improvements 14,487 Relocation 31,315 Loss of Rental Income 300 Rehabilitation of Public Structures 10,000 Rehabilitation of Private Properties 284,254 185,000 Code Enforcement 29.531 Project Totals $703,707 $237,310 Planning and Management $ 15,000 Administration 120,983 TOTAL $1,070,000 83-232 LEASE AGREEMENT AMENDMENT This LEASE AGREEMENT AMENDMENT, executed in duplicate counterparts, is entered into this day of , 1983, by and between: CITY OF BANGOR, a municipal corporation located in the .County of Penobscot, State of Maine (hereinafter. sometimes referred to as the.'C1ty") AND BANGOR MAINE ASSOCIATES, a Maine Limited Partnership, having a place of busines c/o Anderson -Nichols, Inc., Oe Merchants Plaza, Bangor, Maine (hereinafter. sometimes referred to a "Lessee") WITNESSETH: WHEREAS, the City and the Lessee entered into a Lease Agreement dated March 1, 1983 relative to the lease of certain parking space. within the downtown area of Bangor, ten of which spaces are situated in the lower level of the Columbia-Hasmwnd Street Parking Deck located at the southeasterly corner of the intersection of Hammond Street and Columbia Street; and WHEREAS, the term of the lease relative to said parking deck spaces commences on July 1, 1983; and WHEREAS, the Lessee is desirous of amending said Lease Agreement to change the commencement date of the term of the lease for seven of the - ten parking spaces situated in said Parking Deck. NOW., THEREFORE, in consideration of the mutual covenants, promises, and agreements herein contained, the parties hereby agree to amend the aforementioned Lease Agreement as follows: I. That the second sentenceof Article II be deleted in its entirety and replaced with the following two sentences: AND, TO HAVE AND TO HOLD the remainder of the demised premises identified on Exhibit B and the three most northerly of the demised parking spaces identified on Exhibit A unto the Lessee for an initial period commencing on the 1st day of July, 1983 and expiring on the 30th day of June, 1986, unless sooner terminated as provided herein. AND, TO HAVE AND TO HOLD. the. remainderofthe demised parking spaces identified on Exhibit '- A,(seven spaces) unto the Lessee for an initial period. -com- mencing on the 1st day of January, 1984 and expiring -on -the - 30 day of June, 1986, unless sooner terminated as provided herein. 2 2. That the first sentence of Article III be deleted in its entirety and replaced with the following: The rental to be paid by the Lessee to the City during the initial term of this Agreement and any extensions thereof by virtue Of options granted hereunder shall be thea=of Thirty Dollars ($30.00) per month for each of the parking ' spaces identified on Exhibit A. 3. Except as hereinbefore modified and amended, the lease Agree- ment dated March 11 1983 by and between the parties shall continue in full force and effect,as originally executed.
