Summary This Ordinance will amend Chapter 165 of the Land Development Code to rezone approximately 73 acres of land from Park and Open Space District (P&O) and Urban Residence 1 District (URD1) to create one Urban Residence 1 District (URD1) parcel. The City is seeking to redevelop this property as a single family dwelling, which is consistent with the current uses adjacent to the property. The lot size is 30,000 square feet, which is larger than the average lot size of 7400 SF in the surrounding neighborhood. CITY COUNCIL ORDINANCE Date: 08/12/2019 Assigned to Councilor: Schaefer 19-312 08/12/2019 ORDINANCE, Amending Chapter 165, Land Development Code — Zone Change —40 Nelson Street from Parks and Open Space to Urban Residence 1 District WHEREAS, the Comprehensive Plan of the City of Bangor has identified this property as suited for Urban Residence District, and WHEREAS, the property in question can access public utilities, and WHEREAS, this property is in an urban developed portion of the city which could accommodate a single family home. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT That the zoning boundary lines as established by the Zoning Map of the City of Bangor dated October 28, 1991, as amended, be hereby further amended as follows: By changing a parcel of land located on 40 Nelson Street (Tax Map 31 -Lot 51-A, from Parks and Open Space (P&O) to Urban Residence 1 District (URD1). Said parcel of land containing approximately .73 acres and being more particularly indicated on the map attached hereto and made a part hereof. Gould, Planning Officer SUBJECT: Amending Zoning Ordinance Zone Change 40 Nelson Street Parks & Open Space to Urban Residence 1 District - C. O. #19-312 Please be advised that the Planning Board at its meeting on September 3, 2019, 2019 held a Public Hearing on the above Zone Change. Chairman Ken Huhn opened the public hearing and asked the City representative to make a brief presentation of the change. The Director of Community and Economic Development provided the Board with the background on the proposed ordinance change. She noted this City property could provide housing in this location. The area is a mix of Parks and Open Space and URD-1 and UD2 Zoning. As such it is a potential location for housing development. The Chair asked for other proponents. Steve Hall, representing the development team indicated they have reached a compromise with the abutting property owner Martin Brown such that their development will be located to the south side of the property and Mr. Brown could acquire the northerly portion behind his house. They would permit and initial structure off Drummond Street and then a second structure on the land to be rezoned. Martin Brown indicated he was a proponent of the change as it would provide for him to acquire a portion of the land behind his him which he could possibly build on. The Chairman asked for comments from the Planning Office. Anne Krieg indicated she typically looks at two issues related to rezoning’s; what are the differences in the two zones and their implications, and what guidance does the Comprehensive plan provide. She noted the plan provides for some Parks and Open Space Zoning and some low density residential zoning. Therefore consistency is not a concern. Relative to adjacent zone there is a mix of single family and multifamily so URD-1 should fit with existing development. Chairman Huhn closed the public hearing. Member Durgin made a motion to recommend the Zone Change to the City Council Member Bazinet seconded the motion and the Board voted unanimously to recommend the proposed amendment to the City Council as contained in C.O. #19-312.
