Summary This Ordinance will amend Chapter 165 of the Land Development Code to rezone approximately 73 acres of land from Park and Open Space District (P&O) and Urban Residence 1 District (URD1) to Urban Residence 2 District (URD2) The City is seeking to redevelop this property as single family or multifamily housing, which is consistent with the current uses adjacent to the property. The lot size is 30,000 square feet, which could potentially accommodate a four unit building. Given the desire for more safe and affordable housing units, the city is proposing this because of its proximity to services including transit. CITY COUNCIL ORDINANCE Date: June 24, 2019 Assigned to Councilor: Schaefer 19-260 06/24/2019 ORDINANCE, Amending Chapter 165, Land Development Code — Zone Change —40 Nelson Street from Parks and Open Space and Urban Residence 1 District to Urban Residence 2 District to Urban Residence 2 District WHEREAS, the Comprehensive Plan of the City of Bangor has identified this property as suited for Urban Residence 2 District, and WHEREAS, the property in question can access public utilities, and WHEREAS, this property is in an urban developed portion of the city which could accommodate a single family home or multifamily housing. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT That the zoning boundary lines as established by the Zoning Map of the City of Bangor dated October 28, 1991, as amended, be hereby further amended as follows: By changing a parcel of land located on 40 Nelson Street (Tax Map 31 -Lot 51-A, from Parks and Open Space (P&O) and Urban Residence 1 District (URD1) to Urban Residence 2 District (URD2). Gould, Planning Officer SUBJECT: Amending Zoning Ordinance 40 Nelson Street — Urban Residence 1 District (URD1) and Park and Open Space District (P&O) to Urban Residence 2 District (URD2) — Council Ordinance 19-260 Please be advised that the Planning Board at its meeting on July 2, 2019, held a Public Hearing on the above zone change request. Chairman Huhn asked the applicant to make a brief presentation of the request. Mr. Tyler Collins of Community and Economic Development indicated that the City had put out and RFP for this land to be a potential development site. He noted that the URD2 would provide more flexibility to establish multiple dwelling units which is consistent with some of the adjacent zones. Chair Huhn asked if there were any other proponents. Being none, he asked for any opponents. Martin A. Brown of 58 Nelson Street addressed the Board. He indicated he had resided at this location for thirty years. The land to be rezoned has been like a neighborhood park where people walk their dogs there. Given the frequent homeless populations he was less inclined to own the property or look after it. He did submit a proposal to the City to acquire the property and gift it back for use as open space. The site has some steep terrain and erodes toward Division Street. He noted some of the property was within the Shoreland Zone which would impact development. The Chairman asked if there were any other opponents to the rezoning request. Stephen Corliss who resided at 50 Nelson Street agreed with Mr. Brown as to the limitations to the land for development. Planning Officer Gould provided some background as why the property was in Parks and Open Space. At one time it was the City's intent to have a greenway along the Kenduskeag Stream. While some land was rezoned to P&O it was never added to 2 the listings of Parkland of the City. Given its location in the urban core, it has potential to be used for housing. Given its size there is the potential that a four unit building could be located somewhere on the property. With the recent interest in housing the City requested proposals for development on this site. Some members of the Board thought that the development potential should be further reviewed. Member Kenney made a motion to recommend the City Council adopt C.O. #19-260, amending the Zoning at 40 Nelson Street from URD1 and P&O to URD2. Member Brush seconded. The Board voted none in favor and seven opposed to recommend the requested change in zoning. Board members noted they were concerned with then suitability of the property for development.
