HomeMy WebLinkAbout2019-05-13 19-172 Order 05/13/201919-172 05/13/2019 19-172 Legal Order N/A Title, Order Authorizing Acceptance of Assignment and Release from Urban Renewal Authority In 1957 the Maine Legislature enacted the Urban Renewal Authority Law. The Legislature authorized a municipality to create an “Urban Renewal Authority”. 30-A M.R.S.A. §5102 (1). The Legislature gave the Authority the power to carry out the purposes of the enabling legislation. The City of Bangor, pursuant to the legislation, created the Bangor Urban Renewal Authority. The intent was to implement federally funded urban renewal projects. Federal funding for the urban renewal program ended in 1974. Previously the City approved the acquisition by the City of property owned by the Bangor Urban Renewal Authority. The City, through the acquisitions, accepted all of the rights and responsibilities of the Bangor Urban Renewal Authority with regard to these properties. This Order will authorize the execution of an Assignment and Release with the Bangor Urban Renewal Authority to accept the transfer or any rights and property interests that the Urban Renewal Authority has with respect to any property rights, including the right to enforce, amend or release any terms, conditions and restrictions included in prior instruments reserved or granted by the Urban Renewal Authority and any ownership in any real estate. Recommend for passage Consent 05/13/201919-172 CITY OF BANGOR ORDER 05/13/2019 19-172 Tremble Authorizing Acceptance of Assignment and Release from Urban Renewal Authority WHEREAS, in 1957 the Maine Legislature enacted the Urban Renewal Authority Law; and WHEREAS, the City of Bangor, pursuant to the legislation, created the Bangor Urban Renewal Authority with the intent to implement federally funded urban renewal projects and Federal funding for the urban renewal program ended in 1974; and WHEREAS, the City has previously approved the acquisition by the City of property owned by the Bangor Urban Renewal Authority with the City, through the acquisitions, accepting all of the rights and responsibilities of the Bangor Urban Renewal Authority with regard to these properties; and WHEREAS, it is now in the best interest of the City of Bangor to accept the transfer of any rights and property interests that the Urban Renewal Authority has with respect to any property rights, including the right to enforce, amend or release any terms, conditions and restrictions included in prior instruments reserved or granted by the Urban Renewal Authority and any ownership in any real estate. Be it Ordered by the City Council of the City of Bangor that, Catherine M. Conlow, City Manager, is hereby authorized on behalf of the City of Bangor to execute an Assignment and Release with the Bangor Urban Renewal Authority to accept the transfer of any rights and property interests that the Urban Renewal Authority has with respect to any property rights, including the right to enforce, amend or release any terms, conditions and restrictions included in prior instruments reserved or granted by the Urban Renewal Authority and any ownership in any real estate.
