488
This Order would authorize the City Manager to sign a Declaration of Environmental Covenants for two lots
owned by the City and leased by General Electric.
The City owns property on Polk Street near the Airport (Map 001, Lots 466 and 488) that it leases to
General Electric. For many years, this property has had restrictions on it outlined in two Administrative
Orders of Consent (AOCs) from the Maine Department of Environmental Protection (MDEP). These
restrictions generally have to do with excavating or digging on the property, along with certain testing
requirements.
General Electric is now looking to have the AOCs terminated, primarily because there is no longer the need
for the amount of testing that was required. MDEP agrees, but has requested that restrictive covenants
be put in place. As the City is the owner of the land, the City must sign the restrictive covenants.
The proposed covenants would require MDEP approval before any digging in certain areas on the property,
any removal of groundwater, or a change in the use from commercial or industrial to some other use (e.g.
residential). These covenants will allow GE to continue using the property as the City’s tenant, remove
most testing requirements, and preserve the ability of commercial and industrial users to use this property.

WHEREAS, the City owns lots 001-466 and 001-488 near the airport;
WHEREAS, General Electric leases said lots;
WHEREAS, in order to terminate certain Administrative Orders of Consent regarding said lots, the City must
sign a Declaration of Environmental Covenants;
WHEREAS, said Declaration would require Maine Department of Environmental Protection approval before any
digging in certain areas on the property, any removal of groundwater, or a change in the use from
commercial or industrial to some other use;
WHEREAS, said Declaration will allow GE to continue using the property as the City’s tenant, remove most
testing requirements, and preserve the ability of commercial and industrial users to use this property;
Be it Ordered by the City Council of the City of Bangor that,
The City Manager is hereby authorized to execute a Declaration of Environmental Covenants for the land at
Map 001, Lots 466 and 488 on the City of Bangor tax maps, requiring Maine Department of Environmental
Protection approval before certain work is performed or changes in use are made. Such Declaration shall be
in final form as approved by the City Solicitor or Assistant City Solicitor.
