THAT WiIERFAS, the properties on both sides of Frazier Street said Gridley Street and a portion of Church Lane have been acquired under the East Side Community Development program, and all buildings have been removed therefrom, and WHEREAS, there is no longer any public necessity to retain the rights-of-way on Frazier Street, Gridley Street, and Church Lane between Frazier Street and Gridley Street, ADW, THEREFORE, Be It ORDERED, THAT the City Ercgineer, acting for and on behalf of the Municipal Officers according to the provisions of 23 M.R.S.A. Sec. 3026, be and hereby is ordered to take the necessary action to discontinue said Frazier Street, Gridley Street and that portion of Church Lane lying between the termini of Frazier Street and Gridley Street (the remainder of Church Lane having been discon- tinued in 1955), more fully described as follows: BRAZIER STREET An unaccepted street, the southerly line of which is described as follows: Beginning at a point on the easterly right-of-way line of Boyd Street at Coordinates North 353,611.83, East 431,949.965 Maine State Coordinate System, East Zone, said point of beginning being two hundred six and ninety one hundredths (206.90) feet north from the northerly right-of-way line of Hancock Street, be measured along said easterly line of Boyd Street; thence North 70 03' 59" East for a distance of three hundred twenty-three and thirty-seven one hundredths (323.37) feet to the westerly right-of-way line of Church Lane. Said right-of-way was laid out twenty (20) feet north and at right angles to the above-described line. CHURCH LANE (A PORTION OF) An unaccepted street, the westerly line commencing at the southeasterly terminus of Frazier Street as described above; thence -1- North 100 15' 10" West along the westerly line of Church Lane for a distance of seventy-nine and eleven one hundredths (79.11) feet to the westerly terminus of the southerly right-of-way line of Gridley Street. Said right-of-way was laid out to a width of twenty (20) feet measured in an easterly direction at right angles to the above-described line. GRIDLEY STREET Laid out and accepted as a public way on March 5, 1855, the southerlyy line of which commences on the westerly right-of-way line of Chur&h Lane at the last point described above, and extend- ing North 66 00` 28" East for a distance of two hundred twenty- six and two one hundredths (226.02) feet to the westerly right-of- way line of Newburyry Street. Said right -o£ -way was laid out to e width of forty (40) feet in a northerly direction at right angles to the above-described line. And be it further CRXERED, THAT the City Engineer proceed to give best prac- tical notice to all of the abutting property owners and the planning Board; and the City Engineer is further ORDERED, TO make a written return of said action containing the bounds and admeasurements of said discontinuance together with a list of abutting property owners and the amount of damages, if any, to be paid as a result of said discontinuance, all in accord- ance with the laws of the State of Maine. -2- - In City Council December 13.1983 Passed Vote nes 6 xo83-38.
