By tka City Cm wR ofthe a tr ofRawyor ORDERED, THAT WHEREAS, various properties located between Larkin Street and Walter Street, southeast of Third Street, have experienced basement flooding during periods of heavy rain, and WHEREAS, an investigation of the existing collector sewer extending between Larkin Street and Walter Street has determined. that the sewer is in very poor condition and in a state of partial collapse, and requires immediate replacement, and WHERREAS$ the development of the neighborhood since the original sewer was installed in 1906 would, prohibit the installation of a new sewer in the location of the existing sewer because of the location of buildings and other structures, thereby requiring the acquisition of easements along the proposed route of the replacement sewer, and WHEREAS, public exigency requires the immediate acquisition of the easements to permit installation of the sewer prior to the winter season, VOW, THEREFORE, BE IT ORDERED, THAT the City Engineer, acting for and on behalf of the Municipal Officers according to law, be and hereby is authorized to lay out and establish easements for the proposed new sewer instal- lation where it crosses private property between Larkin Street and Sidney Street, more fully described as follows: Land Owned by Joan M. and Nancy A. Hughes, 125 Larkin St., Described in Penobscot Registry of Deeds in Vol. 3136, Page 163: Beginning at a point on the northeasterly right -o£ -way line of Larkin Street, said point being 8 feet, more or less, northwest from the southeasterly line of said property; thence in a north- easterly direction for a distance of 82 feet, more or less, to a point, said point being 3 feet, more or less, northwest from the -1- southeasterly line of said property; thence deflecting 350 in an easterly direction from the last described line and extending 5 feet, more or less, to the southeasterly line of said property. Land Owned bAlbert A., III and Suzette L. Randall, 121 Larkin St., Lscribed in Penobscot Registry of Deeds in Vol. 2403, Page 278: Beginning at a point on the northwesterly line of said property, said point being 87 feet, more or less2 northeast from the northeasterly right-of-way line of Larkin Street; thence in a northeasterly direction for a distance of 46 feet, more or less, to the northeasterly line of said property at a point located 28 feet, more or leas, southeast from the northerly corner of said property. Land Owned by Charles J. Emery, 128 Sidney Street, Described in Penobscot Registry of Deeds in Vol. 3214, Paas 282: Beginning at a point on the southwesterly line of said property, said point being 14 feet, more or less, northwest from the southerly corner of said property; thence in a north- easterly direction for a distance of 24 feet, more or less, to the southeasterly line of said property at a point located 19 feat, more or lees, northeast from the southerly corner of said property. Land Owned by Abraham Shapiro, 118 Sidney Street, Described in Penobscot Registry of Deeds in Vol. 2009, Page 262: Beginning at a point on the northwesterly line of said property located 122 feet, more or less, southwest from the southwesterly right-of-way line of Sidney Street; thence in a northeasterly direction for a distance of 95 feet, more or less, to a point located 4 feet northwest from the south- easterly line of said property and 46 feet, more or less, southeast from the southwesterly right -of -Way line of Sidney Street; thence deflecting approximately 13 in an easterly direction and extending 6 feet, more or less, to a point on said southeasterly property line, said point being 42 feet, more or less, southwest from the southwesterly line of Sidney Street. AND BE IT FURTHER ORDERED3 THAT the City Engineer proceed to give notice of such intention of said Municipal Officers according to law by posting such Notices for seven (?) days in two (2) public places in the City of Bangor and in the vicinity of the proposed sewer, and the City Engineer is further -2- MERED, To make a written return of said proceedings containing the bounds and admeasurements of said sewer easements and the damages allowed to any person or persona as a result of said laying out, all in accordance with the laws of the State of Maine. -3-
