THAT Chapter. VIII, Article 21, Section 2(5) - Planned Development
he amended by adding the following:
(5) Planned Development. A planned development for shy residential
or commercial complex permitted under
other provisions of this ordinance shall be considered as one
site development parcel under theapplicablesite development
standards of the zoning district in which it Lies and for
subdivision_ purposes regardless of the proposed method of
ownership for the land area, buildings, portionsofbuildings,
site improvements or any combination thereof provided:
1) The planned development shall not create increases
in prescribed densities .and/or lob coverage, or
reduce the required area for yards and off-street
parking orviolate any other site development
standards applicable to the zone.
2) Any method of ownership for the, land area,buildings,
portions of buildings, site improvements or any com-
bination.thereof shall afford those acgquiring such
s
ownership interests -a cess. to and u f such other
portions of the planned developmentas are necessary
for:
a) .Access to all portions of the planned
development from a public right-of-way;
b) Access to the parkingareas required under
this ordinance; or
c) Access to the common areas of the planned
development, including the yards and open
spaces required under this ordinance.

Planned Development - Chapter VIII, Article

Please be advised that the Planning Board at its regular
meeting on September 17, 1984 held a public hearing on the
above zoning amendment.
After considerable discussion about the changing
arrangements for development, sale and ownership ofhousing
and housing sites, the Board recommended five in favor and
none opposed to recommend this zoning amendment to the City
Council, in order to provide additional flexibility for
housing developers.

d) Compliance with the site development standards
required under this ordinance.
3) Applicant shall have the burden of demonstrating that
the proposed method of ownership complies with the
foregoing requirements. To that end, Applicant shall
submit, as part of the site plan and/or subdivision
review process, copies of all proposed documents relating
to the creation of ownership interests, the dedication of
all common areas or elements, and the organizational
arrangements for the ownership, maintenance, use, and
preservation of all common areas or elements of the
planned development.
4) A planned development must receive site plan approval
in accordance with this ordinance.
