THAT the provisions of Chapter IX, Sections 1 and 2 of the crilmnances
of the City of Bangor are hereby ;repealed and replaced with the following:
Sec. 1 BuildingCode Adopted. Inaccordance with Title 30,
Section 2156, Maine Revised Statutes Annotated of 1964,
a amended, "The BOCA Basic National Building Code/1984
Ninth Edition, published by the Building Officials 6
Code Administrators International, Inc., is hereby adopted
and corporated by reference, as the minimum standard
for the construction, alteration, addition, repair,
removal, demolition, use, location, occupancy, and
maintenance of all buildings and structures and their
service equipment, both existing and proposed, located
within the City of Bangor.
Sec. 2 Amendments to Published Version. Said Building Code is
adopted inits published form as it fully set forth herein,
except as follows:
(1) Article 1, section 100.1 is amended to read as
follows:
100.1 Title: These regulations shall be known
as the Bu Tding Code of the City of Bangor hereinafter
referred to as "this code".
(2) Article 1, Section 100.2 is amended to read as
follows:
180.2 Scope: These regulations shall control all
matters coming the construction, alteration,
addition, repair, removal, demolition, use, location,
occupancy and maintenance of all buildings and
structures and their service equipment as herein
defined, and shall apply toexisting or proposed
buildings and structures in the City of Bangor;
except a such matters a otherwise provided for
n the locl jurisdictional charter, or other
ordinance or statutes, or in the rules and regulations
authorized for promulqation under the provisions
of this code.
(3) Article 1, Section 103.1 is amended to read as
follows:
103.1 Continuation of exiatina a The legal use
and occupancy o£ any structure existing on the
effective date of this ordinance or for which it
had been heretofore approved, may be continued without
change, a cept as may be specifically covered i
this Code, the Property Maintenance Code and the
Life Safety Code and subsequent amendments thereto,
or s may be deemed necessary by the building
officials
for the generalsafety and welfare of
the occupants and the public.
(4) Article 1, Section 109.1 is deleted and replaced
with the following:
109.1 Buildin Official: Further references in
this co a toe tong official" shall be
interpreted to mean the aDirector of Code Enforcement
of the City,,of.Bangor.
(5) Article 1, Section 111.3 is deleted and replaced
with the following:
111.3 B Whom A lication 'is Made: Application for a
permits 11. a ma e y the ow r lessee of the
building o structure, or agentofeither, or by the
licensed engineer or architect employed in connection
with the proposed work. The full names and addresses
of the owner or lessee, applicant, and of the
responsible officers, if the owner or lessee is a
corporate body, shall be stated in the application.
(6) Article 1, Section 112.2 is amended to read
as follows:
112.2 Suspension of Permit: Any permit issued shall
automatically become i valid if the authorized work is
not commenced within six (6) months after issuance of
the permit, or if the authorized work is suspended
or abandoned for a period of six (6) months after
the time of commencing the work.
)J) Article 1, Section 114.3.1 is deleted and replaced
with the following:
114.3.1 Fee Schedule: .The following fees shall be

(8) Article 1, Section 117.4 is deleted and replaced
with the following: -
117.4 Violation Penalties: My person who shall
violate a.provl� a10� Basic Code or shall fail
to comply with any of the requirements thereof or who
shall erect, construct, alter or repair a building or
structure in violation of an approved plan or
directive of the building official, or of a permit
or certificate issued under the provisions of the
Basic Code shall be guilty of a civil violation
and subject to a fine of not more than $500 for
each violation. Each day such violation continues
shall be deemed a separate offense. All fines
collected hereunder shall inure to the City of
Bangor.
(9) Article 1, 'Section 118.2 is amended to read as
follows:
118.2 Unlawful Continuance: Any person who shall
continue any work lnor about the structure after
having been served with a stop work order, except
such work as he is directed to perform to remove a
violation or unsafe conditions, shall be liable to
a fine of not less than $100 nor more than $500.
All fines collected hereunder shall inure t0 the
City of Bangor.
(10) Article 1, Section 123.3 is amended to read as
follows:
123.3 Compensation 'of board of survey: The third
member o£ the board aha 11 receive for his services
a fee of $50 to be paid by the appellant.
(11) Article 1, Section 124.1 is deleted and replaced
with the following:
124.1 Application for Appeal: The owner of a building
or structure or any other person may appeal to the
Bangor Board of Appeals", hereinafter designated
as the "Board of Appeals", from a decision of the
building official refusing to grant a modification
to the provisions of this code covering the manner of
construction or materials to be used in the a ection,
alteration or repair of a building or structure.
Such appeal shall be commenced on a form provided
by the Director of Code Enforcement together with a
administrative processing fee of Twenty -Five Dollars
($25.00).
(12) Article 1, Section 124.2 is deleted and replaced
with the following:
124.2 Membership -of Board: The Board of Appeals shall
consistof—five (SJ full:miembers and two (2) associate
members as appointed by the Bangor City Council. One
full member is to be appointed initially for a five
year term, one for four years, one for three years,
one for two years, and one for one year; thereafter
each new member shall serve for five years until
such time as a successor has been appointed. Associate
members shall initially be appointed for three and
two years, respectively; thereafter each shall serve
a five year term or until a successor has been
appointed. -
(13) Article 1; Section 124._2_.1 is, deleted and_reolaced with
following:
124.2.1 Qualifications of Board Members: Each member
or associate member shall be a licensed professional
engineer or architect, or 'a builder or superintendent
of building construction, with at least ten years
experience, for five years of which that board member
or associate member shall have been in responsible
charge of work; and there shall not be more than
two (2) members or associate members of the board
selected from the same profession or business; and at
least one of the professional engineers shall be a
licensed structural or civil engineer of architectural
engineering experience. Provided, however, that the
appointing authority may, at its discretion, appoint
not more than one (1) layperson as a member or
associate member.
x(14) Article 1, Section 124.2.2 is deleted and replaced
with the following:
124.2.2 Absence of Members: During the absence of a
full member or due to a conflict of interest of a full
member, the Chairperson or presiding officer shall
designate a qualified substitute from among the
associate members, which member shall hear testimony
and vote in the place of the full member. Such
alternate shall meet the same qualifications a required
for regular members of the board and while sitting on
the board shall have the full Poway and authority
of the regular member.
(15) Article 1, Section 124.4 is deleted and replaced with
the following:
124.4 Noticeo£' Meetings: The board. shall meet upon
notice oo the chairman wvthin thirty (30) days of filing
an appeal or at stated periodic meetings if warranted
by the volume of the work.
(16) Article 1, Section 124.8 is deleted and replaced
with the following:
124.8. Court Review: Any person aggrieved by a -
decision ox order of the board may, within thirty (30)
days after the decision is rendered, appeal to the
superior court in accordance with Rule SOH, Maine
Rules of Civil Procedure.
(17) Article 5, Section 581.2 is deleted and replaced with
the following:
501.2 Fire Limits: The fire limits shall comprise all
areas witncity limits of the City of Bangor
except those areas zoned Residential (R-1 through R-5),
Neighborhood Commercial (C-1), and Park 6 open Space
