BANGOR INTERNATIONAL AIRPORT JOINT USE
AGREEMENT DELINEATING RESPONSIBILITIES
FOR FIRE PROTECTION AND SNOW REMOVAL
This agreement made and entered into this day of ,
19_ by and between the City of Bangor,acting through its agency the Airport
Department, (hereinafter referred to as the "CITY"); and the UNITED STATES OF
AMERICA, represented by the Chief, National Guard Bureau and the State of
Maine, acting through the "Adjutant General of the State of Maine persuant to
30 M.R.S.A. 1951 (hereinafter referred to as the 'GOVERNMENT") concerning the
- -'-joint use "of--facilities,-fire protection, -and -snow aM ice-removai at the
Bangor International Airport (hereinafter referred to as the 'Airport')

Wd EREAS, there is located in Bangor an airport facility known as Bangor
International Airport; and WHEREAS, the GOVERNMENT presently owns land and
facilities adjacent to the Airport; and WHEREAS, the GOVERNMENT wishes to acquire
from the CITY, Ninety one and 4 tenths (91.4+) acres of land for Air National
Guard and Air Force use contiguous with said present GOVERNMENT owned land and
facilities (See description attached as Exhibit A); and WHEREAS, the CITY seeks
to continue several beneficial Joint Airport Use Agreements delineating air-
port maintenance responsibilities, snow removal and Fire Protection between the
CITY and the GOVERNMENT; and WHEREAS, the present Airport Agreements are altered
in practical effect by the new acquisition of property by the GOVERNMENT; and
WHEREAS, the CITY, and GOVERNMENT desire to enter into a consolidated agreement
for Joint airport use, Fire Protection, and Snow Removal Responsibilities in
light of the proposed GOVERNMENT property acquisition; NOW, THEREFORE, the parties
hereto, for the consideration hereinafter mentioned, do hereby covenant and agree
as follows:
r 1. PURPOSE: The purpose of this agreement is to establish a con-
solidated agreement providing reasonable share, proportioned to such use, main-
tenance, snow removal, and fire protection in consideration of the circumstances
of GOVERNMENT land acquisition at the Airport.
2. LAND ACOUISITIONAMPROVEMENT.
a. The CITY agrees to provide the GOVERNMENT with a quit claim deed
(with description satisfactory to the GOVERNMENT) conveying Ninety one and four
tenths (91.4*) acres described in Exhibit A. The stated consideration shall be
one dollar and other valuable consideration.
—b.-Th"OVERNMENT is to "construct -m newsecuritygate at the Air
National Guard Bangor facility at a point where the Illinois Avenue intersects
with the boundary of the proposed acquisition and other land of the CITY, a point
approximately four hundred (400?) feet easterly along the Illinois Avenue from
the GOVERNMENT'S present boundary. The Air National Guard will improve drainage,
rebuild and widen the segment of Illinois Avenueownedby the CITY between the
said proposed gate location and Griffin Road. The improvements will be in
conformity with the improvements to the said road and drainage within the pro-
posed GOVERNMENT boundaries.
3. JOINT USE: Subject to the terms and conditions of this agreement:
a. The GOVERNMENT shall have the use, in common with other users
of said Airport, of the flying facilities of the Airport, together with all
improvements and facilities pertaining thereto, and situated there on, as. may
be added to or constructed from time totime upon the landing area, and all
necessary and convenient rights of ingress and egress to and from such "common
use" flying facilities and other GOVERNMENT facilities located an the Airport.
Routes for ingress andel egress for the GOVERNMENT employees, their agents,
customers, and contractors shall not unduly restrict the GOVERNMENT in its
operation.
b. Authority for joint use agreements with a municipality con-
cerning the use of GOVERNMENT Fire Protection and snow removal equipment is
found in Act of May 27, 1955, C.105, Sections 1 - 5, P.L. 46 (69 Statute 66) 42
'U.S.C. Section 1856 - 1856d, and M.R.S.A. Title 30, Section 1951.
4. CITY RESPONSIBILITIES: The CITY will be responsible for performing any
and all maintenance of the jointly used facilities in accordance with FAA stan-
dards, which shall include but not limited to the following:
(a) Airfield pavements, to include joint sealing, crack repair,
surface repairs, airfieldmarkings and repair/replacements of damaged pavement
sections.
- - (b)— A-i"rfia Id -lighting, to include ru nway'and Y iway lights; -regu-
lators, and controls for same.
(c) Navigational aids, to include beacons, indicators, obstruction
lights, wing indicators etc.
_ (d) Unpaved areas., to include grass cutting, dust and erasion
control, etc.
(e) Furnishing utilities necessary to operate the jointly used
facilities.
(f) Provide servicing and/or maintenance of authorized civilian
aircraft
(g) The CITY will provide fire protection and snow and ice removal
personnel subject to paragraph 6 below.
(h) The CITY will provide full structural fire protection of all
GOVERNMENT property on or adjacent to the Airport.
5. GOVERNMENT RESPONSIBILITIES: The GOVERNMENT will be responsible for
the following:
a. Removal of disabled military aircraft as expeditiously as
possible, at no expense to the CITY, in order to minimize the time any part of
the airfield would be closed.
h. The GOVERNMENT reserves the right to provide, at no expense to
the CITY, airfield markings required soley for military aircraft operations.

c. The GOVERNMENT maintains a firefighting and crash rescue organ-
ization in support of military operations at the airport. The GOVERNMENT addi-
tionally maintains snow removal equipment capable of servicing the civilian
needs and FAA requirements at the Bangor International Airport. The GOVERNMENT
agrees to provide the CITY aircraft firefighting/crash rescue services and snow
removal equipment subject to paragraph 6 of this agreement and, the terms of this
paragraph below. The GOVERNMENT shall have no obligation to provide any
increase beyond that currently supplied in firefighting/crash rescue equipment,
firefighting personnel or snow removal equipment. However, the GOVERNMENT-
:--_ __—guarantees -Soley.. through the AIR NATIONAL GUARD to maintain the present capabi-
lities provided the Airport by the firefighting/crash rescue organization,
firefighting/snow removal training and instruction, and the maintenance and pro-
viding of firefighting/crash rescue equipment and snow removal equipment. The
AIR NATIONAL GUARD further agrees to insure the substitution of funding of their
min to provide continuity of the above Mentioned equipment, training, and manpower
despite a military mission change that curtails current sources of GOVERNMENT
funding for some.
N. If there is elimination of military necessity for the con-
tinuation of GOVERNMENT fire protection and snow removal at the Airport, the
GOVERNMENT, subject to congressional authorizations and appropriations, will
reconvey the said Ninety one and four tenths (91.4+) acres back to the CITY.
6. JOINT CITY AND GOVERNMENT RESPONSIBILITIES FOR FIRE PROTECTION AND
SNOW REMOVAL IN AIRCRAFT UTILIZED AREAS: The CITY will urn s
fire protection personnel only when civilian aircraft operations requirement
exceed the military requirements at Bangor IAP. Subsections of this paragraph
pertaining to CITY fire protection personnel will apply only when CITY personnel
are required under the terms of this paragraph.
a. PERSONNEL.
(1) The CITY will furnish only fire protection personnel

trained in aircraft fire protection principles as outlined in paragraph 61b(l)
to operate GOVERNMENT equipment listed in Exhibit B, or to man the Airport fire
protection facility.
(2) The CITY will only furnish snow removal equipment personnel
trained in airport snow removal operations as outlined in paragraph 61b(2) to
operate the equipment in Exhibit S. The CITY will provide an adequate number of
trained personnel to keep the aircraft pavementsclearof snow and .ice as
weather conditions warrant.
b. TRAINING OF FIRE PROTECTION/SNOW REMOVAL PERSONNEL.
(1) Train ng of Civilian CITY Fire Protection Personnel will be
supervised by the GOVERNMENT and conducted jointly by the CITY and the
GOVERNMENT and will comply to requirements of ANG directives, FAA Advisory
- Circular 139-49-1 and NFPA Standards for airfield fire fighters. CITY fire
protection personnel will be required to meet ANG licensing requirements for
vehicle operators and fire protection skill levels. The CITY shall furnish
the GOVERNMENT a list of fire fighters who are qualified to work at the ANG
Fire Station by virtue of their training.
(2) Training of the Civilian CITY Snow Removal Equipment
operations supervisor shall be the responsibility of the GOVERNMENT. The super-
visor shall be qualified in accordance with ANG Directives to be an
instructor/trainer of the CITY snow removal personnel. The CITY operator will
be required to meet ANG licensing requirements. The CITY will furnish the
GOVERNMENT a list of snow removal equipment operators who are qualified by virtue
of their training
c. DIRECTION OF FIREFIGHTING AND SNOW REMOVAL UNITS.
(1) Command of Firefighting operations will rest with the
GOVERNMENT (ANG Fire Chief or his designated alternate) on all incidents
involving both military andcivilianaircraft.

The Air National Guard Fire Chief or his designated representative will have the
authority to direct work accomplishment for vehicle/equipment inspections and
vehicle preventive maintenance.
(2) The CITY shall direct theuse of snow removal equi anent in
accordance with the priorities described in the Bangor International Snow and
Ice Control Plan, Exhibit C, implemented annually. The use of GOVERNMENT
Airfield snow removal equipment use shall be limited to the snow and ice
clearance of aircraft utilized pavements such as active runways, taxiways
(including Charlie Taxiway) add aprons. The ANG snow removal supervisor
shall coordinate the snow and ice removal operations on military aircraft
exclusive use areas. _
d. EQUIPMENT. Fire equipment and snow removal equipment listed in
Exhibit B and issued by ,the GOVERNMENT'to the United States Property and Fiscal
Officer (USPFO) for MCANG use, will be made available to the CITY for use in
accordance with the provisions of this agreement. Itis understood and
agreed that vehicles of equivalent capability may be substituted by the
GOVERNMENT. It is further understood and agreed that the fire and snow removal
equipment is the property of the GOVERNMENT and will continue to be. Subject
to coordination with the CITY, the GOVERNMENT reserves the right of utilization
of any or all equipment for any purpose.
(1) PERSONAL FIREFIGHTER GEAR. The GOVERNMENT may make
available for use by the CITY those various items of fire protection equipment,
such as bunker clothes, air packs, etc., as the same may be available to the
MCANG. Special authorizations will not be established solely to support
requirements of the CITY.
e. FACILITIES.
(1) The GOVERNMENT shall provide facilities in which fire
equipment and personnel will normally be housed, more particularly described

as Building 512. Repair, maintenance, utilities and janitorial costs asso-
ciated with said facility will be borne by the GOVERNMENT.
(2) The GOVERNMENT'S firefighting/crash rescue equipment shall
not be routinely parked on the airfield during non -emergency landings of civi-
lian aircraft.
(3) The airfield snow removal equipment shall be housed in
areas exclusively used by the Air National Gbard. -
f. REIMBURSEMENT FOR USE OF FIREFIGHTING/SNOW REMOVAL MATERIAL.
Reimbursement shall be made to the CITY and GOVERNMENT for all
firefighting agents expended by either party to suppress-Tirein a civilian
aircraft. No other fuel or material reimbursement shall be made by either party
for costs incurred pursuant to the performance of this agreement, beyond the
contribution of equipment use, personnel, structures and supplies herein
provided.
g. OVERALL MAINTENANCE OF FIRE PROTECTION/SNOW REMOVAL VEHICLES.
(1) The GOVERNMENT shall furnish all necessary maintenance,
modification and repair of the vehicles furnished hereunder. Vehicle fuel and
lubricants will be provided by the GOVERNMENT.
(2) Vehicle Checklist. The CITY Agrees that vehicles covered
by this agreement will be checked an a daily basis and a record of such
checks will be maintained by the person or persons performing such checks.
If there is a failure to make such checks on the part of any employee or
agent of the CITY and such failure results in damage to the vehicle, the
CITY agrees to bear the cast of repairing or replacing the vehicle so damaged by
its employee or agent.
h. LIMITATION ON USE OF GOVERNMENT FIRE PROTECTION/SNOW REMOVAL
E T.
(1) The CITY shall not enter into any mutual aid or reciprocal
fire protection agreements with any third party which involve use, or potential

use of GOVERNMENT fire equipment outside the boundaries of Bangor International
Airport. it is also understood that GOVERNMENT fire equipment will not be used
outside the boundaries of Bangor International Airport for any purpose unless
first coordinated with either the Air Commander, Chief of Support Services,
.Base Fire MarshallorBase Fire Chief.
(2) The CITY shall not use GOVERNMENT supplied airport snow
removal equipment except for clearance of aircraft runways, taxiways, ramps and
pads. No snow removal vehicles shall be used to push vehicles on aircraft sur-
faces except in an emergency when directed by the Base Fire Chief.
. LIABILITY ARISING IN FIREFIGHTING/SNOW REMOVAL OPERATIONS.
(1) PARTY/DERIVATIVE CLAIMS - SIMPLE NEGLIGENCE. Each party
waives all claims against the other party for compensation for any loss, damage,
personal injury, or death occurring as a consequence of the simple negligence -in
the performance of, attempted performance of acts related to this agreement or.
any acts performed or attempted to be performed in furtherance thereof. The
Parties of further agree to hold each other harmless for any acts or claims
asserted through or on its behalf, either directly or indirectly, by its
employees, agents, or others, complaining of simple negligent loss, damage, per-
sonal injury, death, or other reimburseable claim, actual or alleged, occurring
as the result of performance, or attempted performance, pursuant to the terms of
this agreement.
(2) PARTY/DERIVATIVE CLAIMS - GROSS NEGLIGENCE/WILLFUL OR
UNAUTHORIZED USE. The Parties agree to indemnify each, other for any acts
arising in circumstances of gross negligence willful or unauthorized use or
maintenance of GOVERNMENT equipment by CITY or GOVERNMENT agents or employees
resulting in loss, damage, personal injury, death or other reimburseable claim,
actual or alleged by the CITY, GOVERNMENT, their employees, agents or persons,

corporations or organizations or persons not party to this agreement. This
indemnification is limited by the immunity limitations of the Maine Tort Claims
Act.
(3) LIABILITIES OF THE GOVERNMENT TO THIRD PARTIES WHEN
RESPONDING TO REOUE OR FIREFIGHTING ASSISTANCE FOR
CIVILIAN AIRCRAFT.
(a) Within the limits of the existing organizational
capabilities, the GOVERNMENT agrees to respond at the CITY'S request to fire
and crash rescue emergencies involving civilian aircraft subject to sub-
paragraph (b).
(b) The CITY agrees to release, acquit and forever
discharge the GOVERNMENT, its officers, agents and employees against any and
all third party claims of whatever description arising out of or connected with
such use of GOVERNMENT firefighting/crash rescue equipment or firefighting per-
sonnel...The CITY further agrees to indemnify, defend, and hold the GOVERNMENT
harmless as required by applicable Air Force regulations for all periods during
which emergency fire fighting and crash rescue service is provided to civilian
aircraft by the GOVERNMENT.-
, ]. TERM. Except as otherwise provided herein, this Agreement shall be
for a a term from - 1984 to 1994, and continuing in full force
and effect beyond that date until either party demands a review and renego-
tiation. Notice of such demand for renegotiation shall be in writing and shall
be delivered by certified mail.to the other party at the addresssetforth in -
subparagraph 10c of this Agreement.
8. TERMINATION. This Agreement may be terminated by the State or
Federal Government at any time by giving at least thirty (30) days' notice
thereof in writing.
9. MDDIFICATION. This agreement may be modified or amended only by
mutual agreement of the parties in writing and signed by each of the parties
hereto.
10. WAIVER. Failure on the part of either party to complain of any
action or non action on the part of the other party no matter how long the same
may continue, shall never be deemed to be a waiver of any of such parties,
rights hereunder. Furthermore, it is covenanted and agreed that no waiver at
any time, of any of the provisions hereof by either party, shall be construed as
a waiver of any of the other provisions hereof, and that a waiver at any time of
any of the provisions hereof shall not be construed at any subsequent time a
-waiver of- the _same -provisivns.
11. NOTICE. Notice required under this agreement shall be sufficient
if sent by Registered U.S. Mail - Return Receipt Requested, as follows:

12. APPROVAL. This Agreement is subject to approval by the Chief,
National Guard Bureau, and is not effective until so approved.

BANGOR INTERNATIONAL AIRPORT
SNOW AND ICE CONTROL PLAN
1983-1984
TASK AGENCIES:
101st AREFW, MCANG and Airport Department, City of Bangor
1. SITUATION: The primary mission of the 101st AREFW, MCANG dictates that tasks
agencies insure systematic and expedient removal . of snow and ice from the active
runway, taxiways, aprons and primary roads on a priority basis.
2. MISSION: To provide effective an sustained operating conditionsduring the
winter season in support of the 101st AREFW, MCANG mission.
3. TASKS FOR PARTICIPATING AGENCIES: -
a. The 101st AREFW, MehAG will:
(1) Provide snow and ice removal equipment from within their resources
to be operated by ANG and City of Bangor personnel.
(2) Maintain ANG equipment as required.
(3) Provide equipment operators as required.
-- (4) Provide, equtpment to be called into use on airfield pavements when-
ever and however the City of Bangor Airport Department directs.
(5) Provide equipment to be used on streets, parking areas, etc., which
will be called into use by the 101st AREFW, MCANG.
b. City of Bangor Airport Department will:
0) Provide trained snow and ice. removal equipment operators.
(2) -Assign, a qualified supervisor to control, and assume responsibility
for:
(a) Snow and ice removal operations on the airfield pavements.
(b) Conduct and performance of equipment operators.
'(c) Preventive maintenance and handling of equipment.
4. ADMINISTRATIVE MATTERS:
a.. Each agency will receive a coo. of this plan. -
b. Agencies participating in snow and ice removal will operate within these
Instructions following the specific courses of action specified herein. If con-
ditions require review to effect a change of procedures during the winter season,
such changes must be provided. in writing before they became binding.
5. COMMUNICATIONS: Snow removal supervisors and crews will maintain com-
munications with tower operators at all times during snow and ice removal opera-
tions using whatever means available.

OPERATIONS PLAN FOR SNOW AND ICE REMOVAL
1. PURPOSE AND SCOPE: To establish procedures and outline responsibilities for
all personnel involved in snow removal operations.
2. REFERENCES: AFM 91-14.
3. GENERAL: Snow and/or ice removal operations will normally begin after
instructions are reviewed from the airport manager, when the snow accumulations
reaches a depth of one inch, or the Commander of the 1Dlst AREFW, MCANG
determines.
a. City of Bangor Airport Manager:
(1) 1s responsible for overall conduct of snow and ice removal opera-
tions on all airfield pavements.
(2) Coordinates all matters related to snow removal operations with the
Commander, NeANG. - -
(3) Retains control of snow removal equipment operations and
establishes a shift schedule for conducting effective operations.
(4) Is responsible for selecting capable supervisors to conduct opera-
tions.
(5) Is responsible for insuring that snow/ice is removed from aircraft
operational ramps, used by the ANG, adequately to meet AND safety requirements
as determined by the 101st AREFM Safety Office. "
b. Commander, MCANG is: _
(1) Responsible for establishing training programs for City of Bangor
Operators.
(2). Responsible for furnishing snow removal equipment to be used on
airfield pavements-.
(3) Responsible for maintaining snow removal equipment and supplying
fuel and oil to same.
(4) Responsible for snow and ice removal on all streets and vehicle
parking lots that are used exclusively by the military.
(5) Responsible for fire lanes to unused military owned property.
c. Airport Department's Snow Removal Supervisor:
(1) Supervises snow and ice.removal operations on airfield pavements.
(2) Directs city snow removal operators. -
(3) Effects coordination with MCAMG to insure effective use of
equipment.
(4) Maintains contact with control tower and is the point of contact
with regard to aircraft movement.

'(5) Is responsible for strict compliance with MCANG vehicle fuel/oil
servicing and fuel pump operating procedures.
d. ANG Snow Removal Supervisor:
(1) Supervises snow and ice removal operations On military exclusive
use areas,
(2) Directs ANG snow removal operators.
4. GENERAL PREPARATION FOR SNOW REMOVAL SEASON:
a. Markers will be installed on all obstacles and underground or surface'
mounted structures or facilities prior to the first snowfall.
b. Snow removal equipment must be in readiness prior to the first snowfall.
c. Material required for snow removal operations will be procurred and
- stockpi led by 15 September eacb year. -
d. A comprehensive training program will be developed and implemented so
that inexperienced -equipment operators will -be properly trained prior to -
beginning operations.
5. AIRCRAFT MOVEMENTS: The Control Tower will be the point of contact for
movesofaircraft. The Control -Tower will notify the Snow Removal Supervisor of
impending aircraft moves sufficiently in advance to permit removal of ice and
snow removal equipment from the active runway and taxiways.
6. ICE REMOVAL PROCEDURES:
a. The removal o4 ice after it has formed is a slow, tedious and costly
operation. To remove thick ice a high down pressure will be exerted on the
cutting edge of the 'ice scraper to plane off about 3/8" of ice per pass. When
the ice is shaved to about a In" thick, the pressure will be reduced for the
final cut. To prevent damage to pavements, shaving to less than V4" is not
recommended. The deicing agent, Urea, Type 11, will then he applied to the
remaining thin layer of ice at a rate of one pound per 100 square feet on the
-
center third of the runway. Once melting in this section has been completed the
remaining Urea and liquid will be swept onto the adjoining ice to continue ice
removal.
b. Since the removal of ice is a slow and expensive operation, the preven-
tion of ice formation is the logical and economical approach. The primary
approach to ice control is the frequent and timely use of snow air blast
sweepers. Prompt and efficient use of these sweepers will in most instances
prevent the build-up of ice or packed snow. However, chemical ice control
agents should be used any time that mechanical equipment cannot provide satis-
factory results.
1. OPERATIONS INSTRUCTIONS: A minimum amount of snow and ice removal is
available at this site. Operators must use extreme caution in plowing near
obstacles and pavement edges. Preventive maintenance procedures must be
followed to insure maximum life span for each piece of equipment. The operations
supervisor must maintain close serveillance over equipment and correct deficien-
cies beforethey-adversely affect this iceandsnow removal capacity. - ----

B. CAPABILITY STATEMENT: Adequate snow removal equipment, spare parts, ice
removal chemicals and equipment operators are on hand or projected to be on hand
to accomplish the snow removal mission.

1. The enclosed Joint Use Agreement negotiated with the City of Bangor
provides for the transfer of 91.4 acres of land to the Air National Guard
in exchange for services as delineated in the Agreement.
2. This Agreement has been reviewed, in draft form, by NGB personnel and
the negotiations were coordinated with Mr. Keith Evans, NGB/CF1. 101st CSS/JA
Capt Gunnar C. Myrbeck has reviewed the document for legal sufficiency.
3. This Agreement was presented to a special meeting of the Bangor, Maine
City Council on Monday, 6 February 1984 at which time it was unanimously
approved. Council members indicated their approval of early entry onto
the land being acquired by the Government. This is essential to insure that
Projects for construction of a new access road can be released for contractor
bidding in the immediate future.
4. Please initiate action to have the Corps of Engineers acquire this land
so that this Agreement can be implemented.

FOR FIRE PROTECTION AND SNOW REMOVAL
This agreement made and entered into this Gun day of February ,
1984 by and between the City of Bangor, acting through its agency the Airport
Department, (hereinafter referred to as the "CITY"); and the bNITEO STATES OF
AMERICA, represented by the Chief, National Guard Bureau and the State of
Maine, acting through the "Adjutant General of the State of Maine persuant to
30 M.R.S.A. 1951 (hereinafter referred to as the 'GOVERNMENT-) concerning the
joint use of facilities, fire protection, and snow and ice removal at the
Bangor International Airport (hereinafter referred to as the "Airport")
WITNESSETH
MHEREAS, thereislocated in Bangor an airport facility known as Bangor
International Airport; and WHEREAS, the GOVERNMENT presently owns land and
facilities adjacent to the Airport; and WHEREAS, the GOVERNMENT wishes to acquire
.from the CITY, Ninety one and 4 tenths (91.4+) acres of land for Air National
Guard and Air Force use contiguous with said present GOVERNMENT owned land and
facilities (See description attached as Exhibit A); and WHEREAS, the CITY seeks
to continue several beneficial Joint Airport Use Agreements delineating air-
port maintenance responsibilities, snow removal and fire Protection between the
CITY and the GOVERNMENT; and WHEREAS, the present Airport Agreements are altered
in practical effect by the new acquisition of property by the GOVERNMENT; and
WHEREAS, the CITY, and GOVERNMENT desire to enter into a consolidated agreement
for Joint airport use, Fire Protection, and Snow Removal Responsibilities in
light of the proposed GOVERNMENT property acquisition; NOW, THEREFORE, the parties
hereto, for the consideration hereinafter mentioned, do hereby covenant and agree
as follows
1. PURPDSE: The purpose of this agreement is to establish a con-
solidated agreement providing reasonable share, proportioned to such use, main-
tenance, snow removal, and fire protection in consideration of the circumstances
of GOVERNMENT land acquisition at the Airport.
2. LAND ACQUISITION/IMPROVEMENT..
a. The CITY agrees to provide the GOVERNMENT with a quit claim deed
(with description satisfactory to the GOVERNMENT) conveying Ninety one and four
tenths (91.40 acres described in Exhibit A. The stated consideration shall be
one dollar and other valuable consideration.
b. The GOVERNMENT is to construct a new security gate at the Air
National Guard Bangor facility at a point where the Illinois Avenue intersects
with the boundary of the proposed acquisition and other land of the CITY, a point
approximately four hundred (400}) feet easterly along the Illinois Avenue from
the GOVERNMENT'S present boundary. The Air National Guard will improve drainage,
rebuild and widen the segment of Illinois Avenue owned by the CITY between the
said proposed gate location and Griffin Road. The improvements will be in
conformity with the improvements to the said road and drainage within the pro-
posed GOVERNMENT boundaries. -
3. JOINT USE: Subject to the terms and conditions of this agreement:
a. The GOVERNMENT shall have the use, in common with other users
of said Airport, of the flying facilities of the Airport, together with all
improvements and facilities pertaining thereto, and situated there on, as may
be added to or constructed from time to time upon the landing area, and all
necessary and convenient rights of ingress and egress to and from such "common
use" flying facilities and other GOVERNMENT facilities located on the Airport.
Routes for ingress and egress for the GOVERNMENT employees, their agents,
customers, and contractors shall not unduly restrict the GOVERNMENT in its
operation.

b. Authority for joint use agreements with a municipality con-
cerning the use of GOVERNMENT fire Protect ion and snow removal eW ipment is
found in Act of May 27, 1955, 0.305, Sections 1 - 5, P.L. 46 (69 Statute 66) Q
U.S.C. Section 1856 - 1856d, and M.R.S.A. Title 30, Section 1951.
4. CITY RESPONSIBILITIES: The CITY will be responsible for performing any
and all maintenance of the jointly used facilities in accordance with FAA stan-
dards, which shall include but not limited to the following:
(a) Airfield pavements, to include joint sealing, crack repair,
surface repairs, airfield markings and repair/replacements of damaged pavement
sections.
(b) Airfield lighting, to include runway and taxiway lights, regu-
lators, and controls for same.
'(c) Navigational aids, to include beacons, indicators, obstruction
lights, wing indicators etc.
(d) Unpaved areas, to include grass cutting, dust and erosion
control, etc.
(e) Furnishing utilities necessary to operate the jointly used
facilities.
(f) Provide servicing and/or maintenance of authorized civilian
aircraft
(g) The CITY will provide fire protection and snow and ice removal
personnel subject to paragraph 6 below.
(h) The CITY will provide full structural fire protection of all
GOVERNMENT property on or adjacent to the Airport.' _
S. GOVERNMENT RESPONSIBILITIES:. The GOVERNMENT will be responsible for
the following:
a'. Removal of disabled military aircraft as expeditiously as
possible, at no expense to the CITY, in order to minimize the time any part of
the airfield would be closed.
b. The GOVERNMENT reserves the right to provide, at no expense to
the CITY, airfield markings required solely for military aircraft operations.

c. The GOVERNMENT maintains a firefighting and crash rescue organ-
ization in support of military operations at the airport. The GOVERNMENT addi-
tionally maintains snow removal equipment capable of servicing the civilian
needs and FPA requirements at the Bangor International Airport. The GOVERNMENT
agrees to provide the CITY aircraft firefighting/crash rescue services and snow
removal equipment subject to paragraph 6 of this agreement and, the terms of this
paragraph below. The GOVERNMENT shall have no obligation to provide any
increase beyond that currently supplied in firefighting/crash rescue equipment,
firefighting personnel or snow removal equipment. However, the GOVERNMENT
guarantees Sole through the AIR NATIONAL GUARD to maintain the present capabi-
lities provided the Airport,by the firefighting/crash rescue organization,
firefighting/snow removal training and instruction, and the maintenance and pro-
viding of firefighting/crash rescue equipment and snow removal equipment. The
AIR NATIONAL GUARD further agrees to insure thesubstitutionof funding of their
own to provide continuity of the above mentioned equipment, training, and manpower
despite a military mission change that curtails current sources of GOVERNMENT
funding for same.
d. If there is elimination of military necessity for the con-
tinuation of GOVERNMENT fire protection and snow removal at the Airport, the
GOVERNMENT, subject to congressional authorizations and appropriations, will
reconvey the said Ninety one and four tenths (91.4±) acres back to the CITY.
6. JOINT CITY AND GOVERNMENT RESPONSIBILITIES EON FIRE PROTECTION AND
SNOW REMOVAL IN AIRCRAFT UTILIZED AREAS: The CITY will furnish
fire protection personnel only when civilian aircraft operations requirement
exceed the military requirements at Bangor IAP. Subsections of this paragraph
pertaining to CITY fire protection personnel will apply only when CITY personnel
are required under the terms of this paragraph.
a. PERSONNEL.
(1) The CITY will furnish only fire protection personnel

trained in aircraft fire protection principles as outlined in paragraph bb(l)
to operate GOVERNMENT equipment listed in Exhibit B, or to man the Airport fire
protection facility. _
(2) The CITY will oniy furnish snow removal equipment personnel
trained in airport snow removal operations as outlined in paragraph GEM to
operate the equipment in Exhibit B. The CITY will provide an -adequate number of
trained personnel to keep the aircraft pavements clear of snow and .ice as
weather conditions warrant
b. TRAINING OF FIRE PROTECTION/SNOW REMOVAL PERSONNEL.
(1) Training of Civilian CITY Fire Protection Personnel will be
supervised by the GOVERNMENT and conducted jointly by the CITY and the
GOVERNMENT and will comply to requirements of ANG directives, FAA Advisory
Circular 139.49-1 and NFPA Standards for airfield fire fighters. CITY fire
protection personnel will be required to meet ANG licensing requirements for
vehicle operators and fire ,protection skill levels. The CITY shall. furnish
the GOVERNMENT a list of fire fighters who are qualified to work at the ANG
Fire Station by virtue of their training.
(2) Training of the Civilian CITY Snow Padova] Equipment
operations supervisor shall be the responsibility of the GOVERNMENT. The super-
visor shall be qualified in accordance with ANG Directives to be an
instructor/trainer Of the CITY snow removal personnel. The CITY operator will
be required to meet ANG licensing requirements. The CITY will furnish. the
GOVERNMENT a list of snow removal equipment operators who are qualified by virtue
of their training.
c. DIRECTION OF FIREFIGHTING AND SNOW REMOVAL UNITS.
(1) Command of Firefighting operations will rest with the
GOVERNMENT (ANG Fire Chief or his designated alternate) on all incidents
involving both military and civilian aircraft.

The Air National Guard fire Chief or his designated representative will have the
authority to direct work accomplishment for vehicle/equipment inspections and
vehicle preventive maintenance.
(2) The CITY shall direct the use of snow removal equipment in
accordance with the priorities described in the Bangor International Snow and
Ice Control Plan, Exhibit C, implemented annually. The use ofGOVERNMENT
Airfield snow removal equipment use shall be limited to the snow and ice
clearance of aircraft utilized pavements such as active runways, taxiways
(including Charlie Taxiway) and aprons. The ANG snow removal supervisor
shall coordinate the snow and ice removal operations on military aircraft
exclusive use areas.
d. EQUIPMENT. Fire equipment and snow removal equipment listed in
Exhibit B and issued by the GOVERNMENT to the United States Property and Fiscal
Officer (USPFO) for MCANG use, will be made available to the CITY for use in
accordance with the provisions of this agreement. It is understood and
agreed that vehicles of equivalent capability may be substituted by the
GOVERNMENT. It is further understood and agreed that the fire and snow removal
equipment is the property of the GOVERNMENT and will continue to be. Subject
to coordination with the CITY, the GOVERNMENT reserves the right of utilization
of any or all equipment for any purpose.
(1) PERSONAL FIREFIGHTER GEAR. The GOVERNMENT may make
available for use by the CITY those various items of fire protection equipment,
such as bunker clothes, air packs, etc.. as the same may be available to the
MCANG. Special authorizations will not be established solely to support
requirements of the CITY.
e. FACILITIES.
(1) The GOVERNMENT shall provide facilities in which fire
equipment and personnel will normally be housed, more particularly described
as Building 512. Repair, maintenance, utilities and janitorial costs asso-
ciated with said facility will be borne by the GOVERNMENT.
(2) The GOVERNMENT'S firefighting/crash rescue equipment shall
not be routinely parked on the airfield during non-energency landings of civi-
lian aircraft.
(3) The airfield snow removal equipment shall be housed in
areas exclusively used by the Air National Guard.
f. REIMBURSEMENT FOR USE OF FIREFIGHTING/SNOW REMOVAL MATERIAL.
Reimbursement shall be made to the CITY and GOVERNMENT for all
firefighting agents expended by either party to suppress fire in a civilian _
aircraft. No other fuel or material reimbursement shall be made by either party
for costs incurred pursuant to the performance of this agreement, beyond the
contribution of equipment use, personnel, structures and supplies herein
provided.
g. OVERALL MAINTENANCE OF FIRE PROTECTION/SNOW REMOVAL VEHICLES.
(1) The GOVERNMENT shall furnish all necessary maintenance,
modification and repair of the vehicles furnished hereunder. Vehicle fuel and
lubricants will be provided by the GOVERNMENT.
(2) Vehicle Checklist. The CITY Agrees that vehicles covered
-ay this agreement will be checked on a daily basis and a record of such
checks will be maintained by the person or persons performing such checks.
If there is a failure to make such checks on the part of any employee or
agent of the CITY and such failure results in damage to the vehicle, the
CITY agrees to bear the cost of repairing or replacing the vehicle so damaged by
its employee or agent.
h. LIMITATION ON USE OF GOVERNMENT FIRE PROTECTION/SNOW REMOVAL
EQUIPMENT.
(1) The CITY shall not enter into any mutual aid or reciprocal
fire protection agreements with any third party which involve use, or potential

use of GOVERNMENT fire equipment outside the boundaries of Bangor International
Airport. It is also understood that GOVERNMENT fire equipment will not be used
outside the boundaries of Bangor International Airport for any purpose unless
first coordinated with either the Air Commander, Chief of Support Services,
'- Base Fire Marshall or Base Fire Chief.
(2) The CITY shall not use GOVERNMENT supplied airport snow
removal equipment except for clearance of aircraft runways, taxiways, ramps and
pads. No snow removal vehicles shall be used to push vehicles on aircraft sur-
faces except in an emergency when directed by the Base Fire Chief.
i. LIABILITY ARISING IN FIREFIGHTING/SNOW REMOVAL OPERATIONS.
(I) PARTY/DERIVATIVE CLAIMS - SIMPLE NEGLIGENCE. Each party
waives all claims against the other party for compensation for any loss, damage,
personal injury, or death occurring as a consequence of the simple negligence..in
the performance of, attempted performance of acts related to this agreement or
any acts performed or attempted to be performed in furtherance thereof. The
Parties of further agree to hold each other harmless for any acts or claims
asserted through or on its behalf, either directly or indirectly, by its
employees, agents, or others, complaining of simple negligent loss, damage, per-
sonal injury, death, or other reimburseable claim, actual or alleged, occurring
as the result of performance. or attempted performance, pursuant to .the terms of
this agreement.
(2) PARTY/DERIVATIVE CLAIMS - GROSS BEGLIGENCE/WILLfUL OR
UNAUTHORIZED USE. The Parties agree to indemnify each other for any acts
arising in circumstances of gross negligence willful or unauthorized use or
maintenance of GOVERNMENT equipment by CITY or GOVERNMENT agents or employees
resulting in loss, damage, personal injury, death or other reimburseable claim,
actual or alleged by the CITY, GOVERNMENT, their employees,. agents or persons,

'corporations or organizations or persons not party to this agreement. This
indemnification is limited by the immunity limitations of the Maine Tort Claims
Act.
(3) LIABILITIES OF THE GOVERNMENT TO THIRD PARTIES WREN

(a) Within the limits of the existing organizational
capabilities, the GOVERNMENT agrees to respond at the CITY'S request to fire
and -crash rescue emergencies involving civilian aircraft subject to sub-
paragraph (b)
(b) The CITY agrees to release, acquit and forever
discharge the GOVERNMENT, its officers, agents and empivyees against any and
all third party claims of whatever description arising out of or connected with
such use of GOVERNMENT firefighting/crash rescue equipment or firefighting per-
sonnel. The CITY further agrees to indemnify, defend, and hold the GOVERNMENT
harmless as required by applicable Air Force regulations for all periods during
which emergency firefighting and crash rescue service is provided to civilian
aircraft by the GOVERNMENT.
7. TERM. Except as otherwise provided herein, this Agreement shall be
for a a term from s Feb 1984 to S Feb 1994, and continuing in full force
and effect beyond that date until either party demands a review and renego-
tiation. Notice of such demand for renegotiation shall be in writing and shall
be delivered by certified mail to the other party at the address set forth in
subparagraph 10c of this Agreement.
B. TERMINATION. This Agreement may be terminated by the State or
federal Government at any time by giving at least thirty (30) days' notice
thereof in writing.
9. MODIFICATION. This agreement may be modified or amended only by
mutual agreement of the parties in writing and signed by each of the parties
hereto
10. WAIVER. Failure on the part of either party to complain of any
action or non action on the part of the other party no matter how long the same
may continue, shall never be deemed to be a waiver of any of such parties'
rights hereunder. Furthermore, it is covenanted and agreed that no waiver at
any time, of any of the provisions hereof by either party, shall be construed as
a waiver of any of the other provisions hereof, and that a waiver at any time of
any of the provisions hereof shall not be construed at any subsequent time a
waiver of the same provisions.
11. NOTICE. Notice required under this agreement shall be sufficient
if sent by Registered U.S. Mail - Return Receipt Requested, as follows:

1. SITUATION: The primary mission of the 101st AREFW, MMNG dictates that tasks

munications with tower operators at all times during snow and ice removal opera-
tions using whatever means available.

OPERATIONS PLAN FOR SNOW AND ICE REMOVAL

3. GENERAL: Snow and/or ice removal operations will .normally begin after
instructions are reviewed from the airport manager, when the snow accumulations
reaches a depth of one inch, or the CommaAder of the 101st AREFW, MCANG

tions on all airfield pavements.
(2) Coordinates all matters related to snow removal operations with the

equipment.
(4) Maintains contact with control tower and is the point of contact
with regard to aircraft movement.

4. GENERAL PREPARATION FOR SNOW REMOVAL SEASON:
a. Markers will be installed on all obstacles and underground or surface
mounted structures or facilities, prior to the first snowfall.
b. Snow removal equipment must bas in readiness prior to the first snowfall.
c. Material required for snow removal operations will be procurred and
stockpiled by 15 September each year.

5C AIRCRAFT MOVEMENTS: The Control Tower will be the point of contact for
moves of aircraft. The Control- Tower: will notify the Snow Removal Supervisor of
impending aircraft moves sufficiently in advance to permit removal of ice and
snow removal equipment from the active runway and taxiways.
6. ICE REMOVAL PROCEDURES: - -
-a. The removal of ice after it has formed is -a slow, tedious and costly -
operation. To remove thick ice a high down pressure will be exerted on the
cutting edge of the ice scraper to plane off about 3/8" of ice per pass. When
the ice is shaved to about a 1/p thick, the pressure will be reduced for the
final cut. To prevent damage to pavements, shaving to less than IA" is not
recommended. The deicing agent, Urea, Type IT, will then be applied to the
remaining thin layer of ice at a rate of one pound per 10D square feet on the
center third of the runway. Once melting in this section has been completed the
remaining Urea and liquid will be swept onto the adjoining ice to continue ice
removal
b. Since the removal of ice is a slow and expensive operation, the preven-
tion of ice formation is the logical and economical approach. The primary
approach to ice control is the frequent and timely use of snow air blast
sweepers. Prompt and efficient use of these sweepers will in most instances
prevent the build-up of ice or packed snow. However, chemical ice control
agents should be used any time that mechanical equipment cannot provide satis-
factory results.
]. OPERATIONS INSTRUCTIONS: A minimum amount of snow and ice removal is
available at this site. Operators must use extreme caution in plowing near
obstacles and pavement edges. Preventive maintenance procedures must be
followed to insure maximum life span for each piece of equipment. The operations
supervisor most maintain close serveillance over equipment and correct deficien-
ciesbefore theyadverselyaffect this ice and snow removal capacity. -

8. CAPABILITY STATEMENT: Adequate snow removal equipment, spare parts, ice
removal chemicals and equipment operators are on hand or projected to be on stand
to accomplish the snow removal mission.
