THAT the zoning boundary lines as established by the Zoning Map
sf the City of Bangor dated September 23, 1974, as amended, be
hereby further amended as follows:
By changing parcels of land located on Mt. Hope Avenue (Tax Map No.
R-63., Parcel No.. 6, Parcel No. 10, and Part of Parcel No. 4) from
Residential 1 Zone to Residential 3 Zone. Said parcels containing
approximately 57.2 acres and being more particularly indicated
on the map attached hereto and made a part hereof.
PROVIDED,HOWEVER,THAT said change of zone is granted subject to the
following conditions:
1. The use and/or operation of the subject premises shall be
subject to the following limitations and/or restrictions:
a. Building height limit . . . . . 2k stories . . . 30'
b. Minimum setback from property. line . . . . . 30'
c. Overall density not to exceed 5.5 units per acre
d. Maximum cluster . . . . . 6 units/building
e. Minimum setbacks -- dwelling. units . . . 25' front

f. Access to building complexes to be provided by an
approved private street.

2. Execution by those parties with an interest is the affected
property of an agreement providing for the implementation and enforce-
ment of all the terms and conditions set forth above and the recording
of said executed agreement in the Penobscot County Registry of Deeds
by the property owner, a copy of said agreement being on file in the
Office of the City Clerk and incorporated herein by reference. In
the event that said agreement is not so executed and recorded within
sixty (60) days from the date of passage hereof, this Ordinance shall
become null and void.
BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT
this Ordinance amendment shall become effective upon the recordation
of s cuted copy of the aforementioned agreement in the Penobscot
County Registry of Deeds or at such time as the same becomes effective
pursuant to the provisions of the City Charter of the City of Bangor,
whichever is later.

Action for a zoning change will be initiated with the Bangor City Council and
referred to the Bangor Planning Board. Statutes require a Public Hearing before the
Planning Board, after a public advertising (at least 10 days prior to such public
bearing), for all changes to the inning ordinance of the City of Bangor. The re-
commendation of the Planning Board is then returned to the Bangor City Council for
final action.

Please be advised that the Planning Board held a public
hearing on the above zone change request at its regular meeting
of February 6, 1984.
After lengthly discussion as to the merits of the contract
proposed in conjunction with this zone change request, the Planning
Board voted by a vote of 4 to 1 to continue the public hearing
to its first meeting in March in order to give applicants an
opportunity to review
objections to the zone change and propose
amended conditions to the contract agreement which might meet with
approval of all the parties involved.
