Hope Avenue (Tax Map No. R-63., Parcel No.. 6, Parcel No. 10, and Part of Parcel No. 4) from Residential 1 Zone to Residential 3 Zone. Said parcels containing approximately 57.2 acres and being more particularly indicated on the map attached hereto and made a part hereof. PROVIDED,HOWEVER,THAT said change of zone is granted subject to the following conditions: 1. The use and/or operation of the subject premises shall be subject to the following limitations and/or restrictions: a. Building height limit . . . . . 2k stories . . . 30' b. Execution by those parties with an interest is the affected property of an agreement providing for the implementation and enforce- ment of all the terms and conditions set forth above and the recording of said executed agreement in the Penobscot County Registry of Deeds by the property owner, a copy of said agreement being on file in the Office of the City Clerk and incorporated herein by reference. In the event that said agreement is not so executed and recorded within sixty (60) days from the date of passage hereof, this Ordinance shall become null and void. Hope Avenue Council Ordinance No. 84-80. Please be advised that the Planning Board held a public hearing on the above zone change request at its regular meeting of February 6, 1984. After lengthly discussion as to the merits of the contract proposed in conjunction with this zone change request, the Planning Board voted by a vote of 4 to 1 to continue the public hearing to its first meeting in March in order to give applicants an opportunity to review objections to the zone change and propose amended conditions to the contract agreement which might meet with approval of all the parties involved. n M.
