ORDERED,
THAT WHEREAS, the City Council by Council Order No. 82-85
passed February S, 1982 authorized the City Manager to sign a
Memorandum of Understanding relative to the reconstruction Of
the intersection of Hammond Street, Odlin Road and Maine Avenue;
and
WHEREAS, the Federal Highway Administration has reclassified
the project to Urban status, which will result in a reduction of
the City's share from twenty-five percent to twenty percent of
the total cost;
now, THEREFORE, Be It
ORDERED, THAT. the City Manager he and hereby is authorized
to sign the attached revised Memorandum of Understanding which
reflects the lower percentage of City participation.
STATEMENT OF FACT:
The original Memorandum of Understanding reflected a total
estimated cost of $300,000.00, and the previous Council Order
authorized that the City's estimated share of $75,000.00 be taken
from the Local Road Assistance Program. The revised Memorandum
of Understanding will reduce the City's estimated share to .,.
$609000.00.

Aereas the subject project hes been included in the Capital Investment
Prrgram, contingent on local coat sharing, it is necessary for the city of
Bangor, hereinafter referred to as the Municipality, and the Maine Department
of Trenieporteticn, hereinafter referred to as the Department, to agree to a
Project coordination and reimbursemaht procefime. -
1 Municipality must indicate their ronamrence in these co®itments, as
outlined, by signing the original of the Memorandum in the spaces prwlded ad

document must be received prior to the beginning or continuation of
preliminary engineering activities.
A. Definitions

savant is for planning purposes only, since it is based

to be used as a basisfor the 'Thmicipal Share."

cost at the completion of the project development pm -
cess, including she coat of engineering, right-of-way,
construction, ad other iteua considered necessary to

estimated poet of a project to be made available by the
Municipality. 'fie municipal Share of the subject project

B. Reimbursement
I. Prior to the bsgioob g or continuation of the project dev-
elopment process, the Municipality will forward a signed
copy of this Mmxendum. Tris will aclumledge that the
level of tie municipal financial obligation toward this
project hWicatai above is acosptable.
2. At the completion of project design arcl right-of-way
appraisal the Dapartmene will notify the Medoipalfty of
the "total estiaeted cost" of the project which is to be
the basis of the payment expected from the Municipality.
This notification will be contained within a municipal/
State Agreement or will be by latter if no Agressent is
required for this project.
3. Our current schedule cells for advertising this project in
the Spring, 1984. Tae cone[ruceinn contract will be
awarded several weeks (usually three) after advertising
for bide. The Municipal Share will be required at that
time. Should the total estimated post of the project as a
result of contract award be differen'. than Chet "Total
Estimated coat," Which determined the "Mmi.cipal Share'
then the Mmlcipality will be responsible only for tbeir
pro -rata stare of the lesser smrnmt.
4. The total financial obligation of the Municipality toward
this project will be completed with the action required by
Paragraph 3. above, unless significant changes in project
scope duriM construction initiated by tin Municipality
result in an increase in toe 'Total Estimated Cost." In
Wrich case, the Municipality is expected to pay the entire
own federal portion of the increased cast.

C. Prroiect Develapuent

s, will arrange for a meeting with the officials of the
Municipality, if dasired by tw- Municipality, to review the
Project limits, scope of or , etc., based on the best infor-
mation available at that time.

3. A Municipal/State Agree ant ® he prepared by the State
formalizing the fubing and will outline the woric to he dore
by the State and that wtdda ie to be performed by the
Mnicipality. If the project's simplicity does not warrant
an Agnea ant, then a letter will be developed indicating the
ammut of the 'Thnicipal Share."
4. lbe Mnfcipality mud the Departma t retain the right to tetm-
inete the project at any time prior to the actual acquisition
of rigbtrof-way. Projects cannot be terminated by the M i-
cipality subsequent to right-of-way acquisition without con-
currence by the Department.
