Section 1 - Adopting Life Safety 'Code. In accordance with Title 30 n.R.S.A., section
2155, an amended, the "Life safety Code 1981', 1981 edition, designated
as 'N.P.P..A. X101', adopted by the, National Fire Protection Association
n July 2, 1981, and published by said Association, is hereby adopted and
mrpomted by reference as the llinimum Standards of Construction,
Protection and Occupancy of structures and buildings located within the
City of Bailout for the purposes of life safety from fire and like
emergeneves.
Section 2 - Fnforcement.Auttegltu. j The Fire Chief, Or his authorised agent(s), shall
have the Trower and duty to enforce the provisions of this rotle.
Section 3 - Enforcement -Procedures, whenever the Fire Chief, or his authorised
agentfs), determine(s) that there is a violation of any provisions of said
code, he/they'shall give written notice of such violation to me prvperty
or the lessama or occupant, or their agent(s). Such written entire
shall:
(1) Include a description of the real estate in question sufficient
for fffintfffcation;
(2) Include a description of the violation(s) found and the citation
to the pertinent provisions of this code;
(3) Sped£y the remedial action required for correction of said
violation(s);
(4) Order that said violations) be corrected within a reasonable
time, such reasonable time to be determined by the Fire Chief
and indicatedupon such written entire; and
(5) State that an appeal from any order, decision, orother action
of the Fire Chief or his authorized agent(s) any be filed with
the Building Board of Appeals by completing a written reddest for
a public hearing with the Director of Code Enforcement within
thirty (30) days after recalpt of said written notice.

Section 3.1 - Appeals. An appeal may he taken from any Order, decision, or other
action of the Fire Chief on his agent(s) to the Building Staid of
Appeals (hereinafter referred t0 as the "BOEXeestablished by
Chapter IS, Section 124.0, at seg., in published edition of the Laws
and Ordinances of the City of Ranger. All appeals must be filed in
writing on prepared forms with the Director of Code enforcement together
with a administration prompting fee of twenty-five ($25.00) dollars
within thirty (30) days from tM date of receipt of the notice. The

or may grant exceptions therefrom when practical difficulties orunnecessary
hardships exist, and it is clearly evident chat reasonable life safety

would thereby be secured. The actions of the Board shall be governed
by the provisions of Chapter IS, Section 124, at seg., in published

Section 3.2 - Appeal to the Superior Count Further appeal from the datision of the
Board may he made to the Superior Court in acmrdunre with rho Maine
Rules of Civil Procedure, Rule BOB.
Section 4 - Prosecution of Violation. Upon the expiration of thenable time
stated in the written notice provided for in Section 3 of this AtHcle,
and the failure to comply with any and all orders, the Fire Chief my
request the City Solicitor and the City Solicitor is hereby authorized
and directed to institute proceedings at law or in equity to compel the
prQnerty Owner, or lessee or occupant, and/or other agent(s) to comply
with the provisions of tbis Article. In addition, the City Solicitor
may file a Complaint in the District Court of the State of Maine for
the purposes of enibrcing the penalty provision Crotained in Section 5
of this Article.
section 5- - Penalties. Every parson, firm, partnership, association, or corporation
wlm shill violate,or uallow to be violated, any provision of
this Article shall, at the expiration of such reasonable time as stated
in the written notice, he guilty of a violation of this ordinance, and
upon co action thereof shall he punished by a fine OF but more than
$100.00 for each violation. Each day hhet much violation continues after
the expiration of such stated reasonable ties, shall be deemed a
separate offense. -
STATEMENT OF FACT:
This ordinance adepts the 1981 edition of the life Safety Code and replaces a
previous edition: the 1976 life Safety Code. This ordinance further clarifies and
takes consistent the manner in which appeals shall be filed.
