And that the avid City Engineer met at the time and place of meeting specified in the notirw and proceeded to bq;x mt disnontinue and uac ste..said dedicated right„ oY. __ Weir, as rollowst –1. sixty (60)footwide right-of-way extending north from the northerly igh way line of Lancaster Avenue to the southerly right -o£ -Way line Of Clark Avenue, a distance of 374 feet, more or less, being an extension of that portion of East Broadway as laid out and accepted as a public way by the City Council on October 13, 1914, as recorded in City of Bangor Road Book Vol. 4, Page 35• There appeared at the time and place set for the meeting Mr. Kenneth F Hendersom,.Jr., a resident of 152 East Broadway, whose property abuts a Small portion of the right -o£ -way to be discontinued. Mr. Henderson was advised that research by the City Engineer has determined that a portion of the right-of-way in question had previously been discontinued by the City Council on March 141 1923 as recorded in City of Bangor Road Book Vol. 4, Page 68, berng that portion extending 300 feet north from the northerly sight -o£ -way line of Lancaster Avenue, and crossing property presently owned by Ralph W. and Lillian W. Hand. The remaining 74 feet from the northerly line of the Hand props to the southerly line of Clark Avenue has not been discontinued. Mr. Henderson spoke in favor of the proposed discontinuance of the remaining portion abutting his propertyy, and indicated that Mr. James E. Givren of 105 Clark Avenue, Mae property abuts the easterly side of said right-of-way for a distance of 74 feet south from the south line of Clark Avenue. is also in favor of Since the right -of -may serves no public purpose, and since all of the abutting property owners between Clark Avenue and Lancaster Avenue are in favor of its discontinuance, it is recommended that said right-of-way be discontinued and vacated in whole in accordance with the provisions of 23 M.R.S.A., Section 3027, and that the land contained in said dedicated right-of-way revert to the abutting property owners in accord- ance with the provisions of 23 M.R.S.A., Section 3026, as follows: Kenneth F Jr.d Suman A Henderson, 152 Et Broadway. A portion of the westerly half of said right-of-way,being a strip of land 30 feet wide and extending south from the south- erly right-of-way line of Clark Avenue for a distance of 74 feet, more or less, to the northerly line of land owned by Ralph W. and Lillian W. Hand. James B. and Mary P. Givran, 105 Clark Avenue. A portion of the easterly half of said rigbt-of-way, being a strip of land 30 feet wide and extending 74 feet, more or less, south from the southerly right -o£ -way line of Clark Avenue to the northerly line of laud owned by Ralph W. and Lillian W. Hand. Ralph W. and Lillian W. Hand, 327 Pine Street. That portion of said right-oS-way, being 60 feet wide and extending 300 feet, more or less, north from the northerly right-of-way line of Lancaster Avenue to the northerly line of said Hand property. -2- It is further recommended that no public easement be retained along the above described right-of-way. Since the right-of-way does not appear on the Official City Map at the present time it is not considered necessary to refer the question of discuut;nuance to the Planning Hoard.
