ORDERED,
THAT the City Manager be and hereby is authorised to sign
Amendment No. 1 to the Agreement for professional services with
Boyle, Termer & Associates, Inc. pertaining to the study and
preliminary design of rehabilitation work on the drainage struc-
tures on the heavy duty apron at Bangor International Airport,
e copy of said Amendment being on file in the Office of the City
Clerk.
STATEMEBT OF FACT:
The Agreement with Boyle, Turner & Associates, Inc. provides
for the study and preliminary design of a solution to the movement
of the concrete pavement on the heavy duty apron at Bangor Inter-
national Airport, including rehabilitation of the existing drainage
trenches. The proposed Amendment, in the amount of $5,225.00,
would allow for the excavation of the concrete pavement in three
locations, and the investigation and evaluation of the joints in
those locations, to be incorporated into the overall study. This
Mork was not originally anticipated as part of the original engineering
Agreement, and will result in additional cost.

BANGOR INTERNATIONAL AIRPORT
-' - - This AGREENENT..made and entered into at Penobscot County, Maine,
effective the 26th day of Fetiruary-"' ;'1985'; ^by -and
between the City of Bangor, Maine (hereinafter called the OWNER)
and the firm of Hoyle, Tanner 6 Associates, Inc., Consulting
Engineers, Londonderry, New Hampshire (hereinafter called the
CONSULTANT).
WITNESSETH:
WHEREAS, the OWNER is the owner and operator. of Bangor Interna-
tional Airport, Bangor, Maine, and
WHEREAS, the OWNER and the CONSULTANT have entered into an
agreement for Engineering Services dated Tune 1, 1983 fora -
design study to determine feasible solutions to the problem of
failure of the transverse trench -type reinforced concrete drain-
age structures located in the area of the main ramp used for
civil air carrier operations both domestic and international.
The foregoing to be hereinafter referred to as the STUDY; and
WHEREAS, ADAP Project No. 6-23-0005-09 and AIP Project No.
3-23-0005-01 provides monies for the STUDY; and
WHEREAS, the STUDY has been approved by the FAA, the Maine DOT
and local government agencies; and
WHEREAS, the CONSULTANT, in the course of the STUDY, has identi-
fied the need to examine the subsurface condition of the joints
in the existing Portland cement concrete pavement; and
WHEREAS, said examination was not included in the scope of work
in the agreement between the OWNER and the CONSULTANT for the
STUDY; and -
WHEREAS, the OWNER, with the concurrence of the FAA, the Maine
DOT, and local goverment agencies, wishes to undertake the
examination of the subsurface condition of the joints; and
WHEREAS, the services of a professional°engineer or engineering
Firm are recuired by the ONMER to evaluate the subsurface condi-
tion othe-joints; and
WHEREAS, such services are of a distinct professional and non-com-
petitive nature; and the OWNER has selected the CONSULTANT to
provide the required services as a continuation of engineering
services already completed;
NOW THEREFORE, in consideration of these premises, the CONSULTANT
and the OWNER agree to amend their AGREEMENT dated the 1st day of
June, 1983, as follows:
e ADD the following Article:
ARTICLE XIII. SCOPE OF SERVICES - EXAM"INATION OF SUBSURFACE
JOINT CONDITION
The CONSULTANT shall undertake the examination of the subsurface
condition of the joints in the existing Portland cement concrete
pavement of the main
amp at Bangor International Airport. The
CONSULTANT•s work under this ARTICLE shall include: -
e. Contracting with and supervising the work of a subcontractor
for the full depth removal ofPortland"cementconcrete _.
pavement inorderto expose the joint for examination;
restoration of the Portland concrete pavement upon comple-
tion of the examination; removal of the existing joint
sealer from the top < inches t of the joint to permit
measurement of the joint width; and resealing of the joint
uponcompletionof the measurements.
e Field measurement and photographing of the existing joints
exposed for examination. -
e Coordination of the above described work with the OWNER.
All materials and construction methods used in the restoration of
the Portland cement concrete pavement shall conform to the
applicable sections of FAA AC150/5370-10.
• Under ARTICLE II., Paragraph B. ^Compensation for Study
Phase' add the following:
2. For providing services under ARTICLE XIII. SCOPE OF
SERVICES - EXAMINATION OF SUBSURFACE JOINT CONDITION,
the amount of five thousand two hundred twenty-five and
00/100 dollars 155,225.001 which includes a fixed fee
payment in the amount of $375.00.
e Revise ARTICLE VI. TIME FOR COMPLETION to read as follows:
The CONSULTANT shall complete all work under ARTICLE I and
ARTICLE XIII of this AGREEMENT including temporary patching
of the portland cement concrete pavement by March 31, 1985.
Permanent restoration of the Portland cement concrete
pavement shallbe completed as soon as weather conditions
permit.
Exhibit C is hereby revised by the addition of the estimated
- costa for ARTICLE XIII.
All other items and conditions of the agreement remain unchanged.
IN WITNESS WHEREOF, the parties hereto have affixed their hands
and seals at Penobscot County, effective the date first above
written.
