ORDERED,
THAT, WHEREAS, the City Council, b9 Council Order No. 176 AC. ,
passed March 12, 1979, has laid out and established Bangor Mall
Boulevard as a public way, extending 1,407.82 feet southwesterly
from Hogan Road, and said right-of-way being 100 feet wide; and
WHEREAS, a portion of the northwesterly line of said right-
of-way near the southwesterly terminus of said road encroaches
upon an existing parking area; and
WHEREAS, a petition has been received from Paine, Lynoh &
Harris, on behalf of Baamek Associates, requesting said right-of-
way line be altered so as not to encroach upon the existing perking
area; and
WHEREAS, it has been determined that said right-of-way line
can be altered by moving the northwesterly right-of-way line 20
feet in a southeasterly direction without affecting or encroaching
upon the existing travel way of said Bangor Mall Boulevard;
ROW, THEREFORE, Be It
ORDERED, THAT the City Engineer, acting for and on behalf of
the Municipal Officers according to law, be and hereby is directed
to lay out an alteration of said Bangor Mall Boulevard right-of-way
line as follows:
Beginning at a point on the northwesterly right -of -may line of
said Bangor Mall Boulevard at the southwesterly terminus as described
in a Deed from Banmak Associates to City of Bangor dated March 28,
1979 and recorded in Penobscot Regietry of Deeds in Vol. 2964, Page
31, said terminuscbeing 1,494.35 Peet southwest Prom the westerly
right-of-way line of Hogan Road as measured along qe northwesterly
line of said Bangor Mall Boulevard; thence North 31 43' 23” East
along said northwesterly right-of-way line for a distance of 267.93
feet to a point, being the intersection of the westerly line of Lot
No. 4 as shown on a Plan entitled "Final Subdivision Plan, Bangor
Mall" prepared by the James W. Sewall Company dated October 13, 1978

recorded in Penobscot Registry of Deeds in File D-2279; thence
South 58n 16' 37" East for a distance of 20 Ieet; thence South
31 43' 23" Neat along a line parallel to and 20 feet southeast
from said northwesterly right -o£ -way line of Bangor Mall Boulevard
for a distance of 267.93 feet to the southsgsterly terminus of
said Bangor Mall Boulevard; thence Worth 58 16' 37" beet for a
dictates of 20 feet to the point of beginning.
Meaning and intending to describe a narrowing of the existing
100 foot right-of-way to a width of SO feet for a distance of
267.93 feet northeast from its southwesterly terminus. And be

out, all in accordance with the laws of the State of Maine.

Dear John
On behalf of Banmak Associates I would like to request that the right of
way line of Bangor Mall Boulevard be altered so as to reduce the width
to 80 feet for a distance of approximately 268 feet fronting along the
Convenience Center, so-called, by moving the northwesterly right of way
line 20 feet in a southeasterly direction.
Pursuant to our conversation, I understand that you will bring this request
to the attention of the Council.
