ORDERED,
THAT the City Manager be and hereby is authorised to enter
into the attached Agreement with the Maine Department of Trans-
portation regarding the reconstruction of the intersection of
Hogan Road and Mount Hope Avenue.

This is the standard MOT Agreement for projects of this
naturae which includes the installation of new traffic signals
and the construction of additional turning lanes at the dater -
section of Hogan Road and Mount Hope Avenue. This projeot is
being funded by MOT.

This AGREEfMNq made this day of 1984, by and -
.between the STATE OF MAINE, acting by aud through its Department of Transportation,
hereinafter referred to as the State, and the CITY OF ShMMI, in the Couity of
Penobscot, a body corporate, hereinafter referred to as the City;
Witre9seth, that
wiEHFAS, the Stateis pleming certain Operational improvements at the intersection
of Hogan Road ani MMunc Hope Avenue in Bangor, including the installation of a
traffic signal, and ; -
WifFEAS, the City agrees such work is necessary;
NOW TIRE, the Parties agree as follows:
I. The State. agreesto the following:
A. To award-acontract for the reconstruction of the intersection of Hogan
Road and Mount Hope Avenm in said Bangor under Federal Aid Project. No.
- HES-1490(4) and for the installation of a traffic signal unier Federal.
'Aid Project Mo. HES-1490(5), all hereinafter referred to as the
Project, substantially in accordance with the plans developed and
prepared by the State.

H. To acquire and pay the cost for all property aid property rights deemed
necessary to construct and perpetually maintain the Project.
C. To provide pavement markings and traffic control signs as necessary on
a. first-time basis.
D. To provide a traffic signal at the intersection of Hagen Road -and Mount
Hope Avenue as aforesaid.
II. AND the City agrees to the folloulog: _
A. To. approve and does hereby approve the layout and construction. of
Federal Aid Projects No. HES-1490(4) and HES 1490(5) as set forth in
Section I, Paragraph A. above.
Hr To approve and does hereby approve the terms set forth in the Special
Provision entitled "Construction Area" attached hereto and made a part
hereof. - -
C. To assame all maintenance and operational costs far the traffic signal
and all related equipment installed as part of this Project, and
further:
1.. To expeditiously correct or repair all deficiencies or malfunctions
in the signal systen as required.
2. To preserve the visibility of the signal by causingall visual
impairments to be removed.
3. To return the traffic signal and all related equipment, %ben
renoved and replaced, to the State without any cost to the State.
4. To maintain paveent markings ani traffic control signs as
necessary.

SPECIAL PROVISION
CONSTRUCTIONARBA
A Covtruetion Area located in the city of Bangor hoe been
established by the Maine State Department of Tranaportation in accordance with
the provisions of Title 29, Section 3703, Maine Revised Statutes Annotated.
The area is described at follows.
(a) The section of highway under construction from Sta.38+34 to Stu. 47`50
of the new construction centerline, plus approaches.
(b) State NighwayPAO 1490 (Mogan M.1from Sta. 38+34 to Sts. 47+50
of the new construction centerline, plus approaches.
The State Department of Transportation or the State's Engineer may issue permits
for. stayed periods of time for moving construction equipment without loads, low -
bad trailers with overloads, over -height, over -width or over -length equipment o
materials a all State maintained sections described in the "Construction Area"
'above and iv addition may issue permits for stated periods of time for moving
Overweight vehicles andloeds. over the 'section described in (a) above. The right
to revoke such a permit at any time is reserved by the State Department of Trans-
portation and the issuance ofsuch permits shall be subject to. any Species provisions
r Supplemental Specifications written for this project.
.A Temporary permit for each move may be'issued by the State Departmant of Trans-
portation or the State's Engineer for moving Contractor's construction equipment
used on the project which exceeds the legal limits (shovels, bulldozers, etc.) to
sourcesof construction material over highways maintained by the state reasonably
within the area of the project.
The Municipal Officers of the - city of Bangor have agreed that
apermit will be issued to the Contractor for the purpose of hauling loads i
excess of the limits as specified in Title 29, Maim Revised Statutes Annotated, on
the town ways as described in the "Construction Area" and that single move permits
will be issued for moving Contractor's construction equipment used on the project
which exceeds the legal limits (shovels, bulldozers, etc.) to sources of construction
amterial over town .ways reasonably within the area of the project.
In the event it is necessary to transport gravel, borrow or other construction
material in legally registered vehicles carrying legal loads over two ways. a
Contractor's gond of not core than Five Thousand Dollars (85.000.00) per mile of
traveled length may Be required by .the town, the erect amount of said band to be
determined prior to use of any town way.
The mximm speed. Limits for trucks on any team way will be coenty-five (25) miles
Far'hour unless a higher legal limit is specifically agreed upon, in writing, by
the Municipal Officers concerned.
