On January 1, 2010 the city entered into a parking lease agreement with Webber Oil Company for 40 parking spaces along Curve Street. The City maintains the parking spaces, including plowing. The spaces have been used by Penquis, the tenant of the building located at 252 Harlow Street. Penquis recently purchased the building from Webber and they have requested continued use of those parking spaces on Curve Street for their employees. If approved, the term of the agreement includes payment of $35 per space, per month for a term of five years. Staff recommends approval. Recommend for passage New Business 02/11/201919-099 CITY OF BANGOR ORDER 02/11/2019 19-099 Sprague Authorizing Termination of Parking Lease with Webber Oil Company and Execution of a Parking Lease with Penquis for Forty Parking Spaces along Curve Street WHEREAS, the City owns 40 spaces of on-street parking along Curve Street that have been leased to Webber Oil Company, the owner of the building at 252 Harlow Street, since 2010 for the benefit of their tenants Penquis; and WHEREAS, the building at 252 Harlow Street was recently purchased by Penquis and Webber Oil Company no longer needs the spaces; and WHEREAS, Penquis has requested to lease the spaces at a rate of $35 per space for a term of five years; and WHEREAS, the lease with Webber Oil Company needs to be terminated and a new lease with Penquis needs to be executed. Be it Ordered by the City Council of the City of Bangor that, Catherine M. Conlow, City Manager, is hereby authorized on behalf of the City of Bangor, to terminate the lease agreement for 40 on street parking spaces on Curve Street with Webber Oil Company and enter into a lease agreement with Penquis for 40 parking spaces on Curve Street at $35 a space for a term of five years. Said lease shall be in a final form acceptable to the City Solicitor or Assistant City Solicitor IN CITY COUNCIL FEBRUARY 11, 2019 CO 19-099 MOTION MADE AND SECONDED FOR PASSAGE COUNCILOR TREMBLE STATED THAT IT HAD PREVIOUSLY BEEN DETERMINED THAT HE HAD A CONFLICT OF INTEREST.
