BY dw my Cowwi! oftlu City Of Imam: ORDERED, THAT, WHEREASt a lotting plan of land formerly owned by the Bangor Real Estate Development Co. in the Hildreth Street area contemplated the extension of Miller Street in a southeasterly direction from its present terminus at Doane Street to Coffey Street, said plan entitled "Lot Plan, Bangor Beal Estate Develop- ment Co., Bangor, Maine" dated June 1951 and recorded in Penobscot Registry of Deeds in Plan Book 16, Page 35; and WHEREAS, said Miller Street extension has never been constructed beyond its present terminus at Doane Street; and WHEREAS, it is considered that the extension of said street would serve no public purpose; and WHEREAS, a petition has been received from Mitchell & Stearns, Attorneys representing D & H, Inc., the owner of land abutting the westerly sideline of said right-of-way, requesting that said right- of-way be vacated; ORDS101 THAT the City Engineer, acting for and on behalf of the Municipal Officers according to 23 M.R.S.A., Sao. 3027, be and hereby is directed to vacate that portion of the Miller Street right -o£ -way lying between the southeasterly right-of-way line of Doane Street and the northeasterly right -of -wag line of Coffey Street, with the exception of a 16.5 foot wide rigbt-of-way owned by the Maine Central Railroad Company as described in a Deed re- corded in Penobscot Registry of Deeds in Vol. 1246„ Page 472, said railroad right -of -wag being located in the approximate center of the SO -foot wide right-of-way to bediscontinued; and be it further ORDERED, THAT the City Engineer proceed to give beat practicable notice to all abutting property owners and the Planning Board; and the City Engineer is further ORDERED, TO make a written return of said action containing the bounds and admeasurements of said vacation, together with a list of abutting property owners and the amount of damages, if any, to be paid as a result of said discontinuencet all In accordance with the laws of the State of Maine. la City Council October 29,1986 86y26 Suspension of the Rules Passed 0 R 0 B R Order Passed - - ireot Title leg City 8ugiweer to Vacate ' a Portion of PB21er Street Between ...................... ................. Francisco (1917.1901 Couvel Luise Sorra Sd Gary F There Please be advised that I represent D & H, Inc., the owner of a parcel of land which abuts the westerly sideline of a proposed way connecting Miller Street with Coffey Street, all as shown on a Lot Plan of Bangor Real Estate Development Company dated June, 1951, recorded in the Penobscot County Registry of Deeds in Plan Book 16, Page 35. For your information, my client acquired title to its property (identified on Tax Map R9 as Lot #7C) by virtue of a deed from The Galt Block Warehouse Company dated March 30, 1977, recorded in said Registry in Volume 2732, Page 11. - It is my understanding that the proposed way has never been accepted by the City of Bangor. On behalf of my client, I respectfully request that you initiate the necessary actions to have the municipal officers vacate that por- tion of the proposed way which extends from Doane Street to Coffey Street IC Street on the Lot Plan) in accordance with 23 M.R.S.A. 43027. Please be advised that Maine Central Railroad Company ona 16.5' strip located within the proposed way, all as described ina deed from Bangor Real Estate Development Company dated June 25, 1946, recorded in said Registry in Volume 1246, Page 472.
