Miller, Qty Solicitor RE: CMrter Revisions Ranting on the agenda are two faders which, if adopted, would initiate the process W permit revisions to our existing Municipal Charter or the adoption of a new Carter, and fothe establisla ant of a Charter Con ission. The Council has been face] with several proposed Charter artzMnents over the past few years. However, this is the first time, to the best of my recollection, that a formal Charter revision process las been proposed. In order for the Council to better mMerstand the process, enclosed Please fiM copies of the relevant provisions of the Hare Rule statute, 30 M.R.S.A. S9 1911, 1912, 1913, aM 1915. the two pending Orders are suttaitted to meet Clue requirenents of 3O M.R.S.A, 5 1912(1) and (5). Unlike charter amenduents, each of Mesa two iters may be adopted without a prior public hearing. Please rote that the question for establishing a Crarter Ca:mission must be sulmitted W the voters at "tire rwe[ regular or special municipal election held cot less than 60 days" after the aloption of the semM Order. Because of the 6o y requirement, this iten will not be in order for consideration by the voters at the November election. The election will have W be held at a special election, or at Ne regular municipal election Mid in Nov anther , 1987. In deciding whether to establish a Carter Cbmnission, the Council sheuld consider the method for claosing members for the Crnmission ant the manner of their operations. these requirmsents are spelled out in 9 1913.
