Be it ordained by the City Cour 'i ofdw City NBaaw,, as fWUow:
THAT the zoning . boundary lines. as. established by the Zoning Map
of the Cityof. Bangor dated September 23,. 1974,asamended,be
hereby further amended as follows:
By changing a parcel of land, located at 157 ParkStreet(Tax Map
No. 41, Parcel. No.,120) from Residential 5 Zone to Commercial 2 Zone.
Said parcel containing approximately 27,000 sq. ft. and being more
particularly indicates on the map attached hereto and made.a part
hereof.
PROVIDED HOWEVER, THAT, in additionto the mandatory conditions
imposed by Chapter. VIII, Article 21. Section,11.3',. Ordinances of the
City of Bangor, said change of zone is granted subject to the following
conditions:
1. The use and/or op station of the subject premises shall. be
subject to the following. limitations and/or restrictions:
a. The applicant makes application for acontract zone change
to C- .zone excluding the following permitted C-2 uses:
b) motel or hotel
€) club or. lodge, private
f) enclosed recreation centers conductedas a gainful
business
g)any other retail, or servicebusiness (except as
referred to under subsection 2 or 3 below) conducted
within a building, with no goods or materials dis-
played or stored outdoors, except goods or materials
of a seasonal nature displayed gar retail sale,
.with outdoor display area limited to 1Z of the gross
floor area of the. building
Also excluding any of the Special Exception provisions
of the C-2 Zone.
2. Execution by those parties with an interest in the affected
property of an agreement providing for the implementation and enforce-
ment of all the terms and conditions set forth above and the recording
of said executed agreement in the Penobscot County Registry of Deeds by
the property owners, a copy of said agreement being on file in the
Office of the City Clerk and incorporated herein by reference. In the
vent that said agreement is not so executed and recorded within sixty
(60) days from the date of passage hereof, this ordinance shall become
null,and void.
BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF. THE CITY OF BANGOR THAT
this Ordinance amendment shall become effective upon the recordation
of an executed copy of the aforementioned agreement in the Penobscot
County Registry of Deeds orat such time as the same becomes effective
pursuant to the provisions of the City Charter of the City of Bangor,
whichever is later.

referred to the Bangor Planning Board. Statutes require a Public nE before the
Plmrdng Board, after a public advertising (at least 30 days prior 20 such public
hearing), for all changes to the coning ordinance of the City of Bangor. The re-
commendation of the Planning Board is then returned to the Bangor City Council for --
final action.

Please be advised that the Planning Board at its regular
meeting on Monday, August 18, 1986, held a public hearing on the
above contract zone change request. After considerable discussion
as to the use limitations contained in the proposed conditions to
this zone change request, the Planning Board 'voted five in favor
and none opposed to recommend approval of the above contract zone
change request (as amended).
