THAT the zoning boundary lines as established by the Zoning Map
of the City of Bangor dated September 23, 1974, as amended, be
hereby further amended as follows:
By changing a parcel of land located at 208 Broadway (Tax Nap No. 47,
Parcel No. 21) from Residential 4 Zone to Residential 5 Zone. Said
parcel containing approximately 14,250 sq. £t. and being more particularly
indicated on the map attached hereto and made a part hereof.
PROVIDED, HOWEVER, THAT,in addition to the mandatory conditions imposed
by Chapter VIII, Article 21, Section 11.3, Ordinances of the City of
Bangor, said change of zone 2s granted subject to the following conditions:
1. The use and/or operation of the subject premises shall be
subject to the following. limitations and/or restrictions:
a. The R-5 use of this parcel shall be limited to a real
property acquisition office staffed by 8 or fewer employees,
together with two single-family apartment units.
b. The office space of the real property acquisitions office
shall be located in the principal building at 2208
Broadway and shall be limited to 2400 square feet of
office space. No other use of the principal building, other
than storage, shall be allowed..
a. The two single-family rental units shall be located solely
within the accessory building at 208 Broadway. No other
use of the accessary building, other than parking spaces
for two vehicles in the open basement, shall be allowed.
d. There shall be adequate off-street parking for all
employeesand tenants at 208 Broadway. No employee shall
park his vehicle on. Broadway.

e. Site plan and special execution approval must be obtained
for the use from the Flaming Board. As an applicant for
special exception approval, the applicant shall provide
screening around the perimeter of the property.
f. Any alterations to and maintenance of thebuildings. shall
be subject to the prior approval of the Bangor Nistozic
Commission. -
g. Any .sign installed at or placed on thebuildings at 208
Broadway shall receive the pPrior approval of the Bangor
historic Commission and she I be limited to 12 inches by
24 inches in size.
2. Execution by those parties with an interest in theaffected
property of an agreement providing for the implementation. and enforce-
ment of all the terms and conditions set forth above and the recording
of said executed agreement in the Penobscot County Registry of Deeds by
the propertyy owners, a copy of said agreement being an file in the
Office of The City Clerk and incorporated herein by reference. In the
event that said agreement is not so executed and recorded within sixty
(60) days from the date of passage hereof, this Ordinance shall become
null and void.
BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT
this Ordinance amendment shall became effective upon the recordation
of an executed copy of the aforementioned agreement in the Penobscot
County Registry of Deeds orat such time as the same becomes effective
pursuant to the provisions of the City Charter of the City of Bangor,
whichever is later.

CONTRACT ZONING CONDITIONS
Patten Corporation - Downeast requests, that in
consideration of the rezoning of this property at 208 Broadway
and in addition to the mandatory conditions imposed by Article
21, g 11.3 of the Zoning Ordinance, the following conditions and
restrictions be imposed upon this specific area to be rezoned
1. The A-5 use of this parcel shall be limited toe real

Action for a zoning change will be initiated with the Bangor City Council and
referred to the Bangor Planning Board. Statutes require a public Hearing before the
Planning Board, after a public advertising (at least 10 Gaye prior to such public
hearing), for ell charges to the zoning ordinance of the City of Bangor. The re-

final action.
