ORDERED,
THAT, WHEREAS, the City Council, in accordance with Council
Order No. 85-183 passed May 13, 1985 has authorized the extension
of the sanitary sewer system in a northeasterly direction from
Hogan Road across property owned by Webber Cil Company to serve
the new Shaw's Supermarket development; and
WHEREAS, said said construction hes been satisfactorily
completed; and

WBEREaS, an easement will be required across said property to
permit future maintenance of said sewer by the City{
ROW, THEREFORE, Be It
ORDERED, THAT the City Treasurer be and hereby is authorized to
accept a Deed from Webber Oil Company conveying an easement for said
sewer, a copy of said Deed being on file in the Office of the City
Clerk.

QUITCLAIM DEED WITH COVENANT
WEBBER OIL COMPANY, successor by merger to Springer
Realty Company, a Maine corporation having its principal
place of business an Bangor, Penobscot County, Maine for
consideration paid grants to THE CITY OF BANGOR, a body
corporate located in Bangor, Penobscot County, Maine, with
quitclaim covenants, the right to enter upon land of the
Grantor in Bangor, Penobscot County, Maine for the purpose
of installing and maintaining a sewer line in a 20 foot wide
strip of land with sidelines an equal distance from the
following described center -line:
Beginning at the intersection of the easterly line of
Hogan Road and the center -line of a 20 foot wide sewer
easement, said point located south eight degrees forty
two minutes twenty three seconds East (S 8" 42' 23" E)
fifty and sixty six hundredths (50.66) feet from the
northwest corner of Lot 3 shown on plan entitled
"Webber Interstate Park" recorded in Penobscot Registry
of Deeds in Plan File O 59-78;
thence North seventy eight degrees fifty one minutes
East (N 780 511 E) one hundred sixty one and thirty
hundredths (161.30) feet to the center of manhole;
thence North eighty five degrees zero minutes East (N
85" 00' E) one hundred eighty six and ninety three
hundredths (186.93) feet to the intersection of the
easterly line of said Lot 3 being the westerly line of
Lot 7 shown on plan entitled "Final Plan of Expansion
of Webber Interstate Park" recorded in said Registry in
Plan File D 139-84, said intersection located South
five degrees fifty five minutes forty seconds East (S
050 55' 40" E) thirty eight and ninety six hundredths
(38.96) feet from the northeast corner of said Let,3
and a corner of said Lot 7;
thence continuing along the same course

three and thirty five hundredths (23.35) feet to the
center of a manhole;
thence North seventy six degrees forty nine minutes
East (N 76° 49' E) three hundred thirty seven and ten

thence North fifty five degrees four minutes East (N
55' 04' E) two hundred ninety three and ninety hundredths
(293.90) feet to the intersection of the northwesterly
line of Springer Drive, so called, and the southeasterly
line of said Lot 7 located South thirty degrees zero
minutes and twenty nine
seconds West (S 301 00' 29" W)
one hundred five and sixty four hundredths (105.64)
fact from the most easterly corner of Lot 7.
Reference Meriden is the same as shown on plan of
Webber interstate Park in Plan File D 9 `-78 being Grid
North.
Together with the right to go on said land and the right to
cut trees, bushes, shrubs, remove roots, pavement and earth
and do other work necessary for the purpose of constructing,
maintaining, operating, repairing, or replacing such sewer
line and related structures, all work to be done to be
performed with reasonable dispatch until fully completed in
such manner as not to cause any unreasonable interference
with the business conducted on or damage or injury or loss
to the Grantor's property or any interruption or interference
with the utility service or drainage facilities serving
Grantor's property or any drainage from its parcel, the
Grantee promptly restoring the portion of the Grantor's
parcel and any improvements thereon used, altered or damaged
in connection with such construction, maintenance, repair
and replacement to the condition they were in immediately
prior to such construction, maintenance, repair and replacement
and if and to the extent necessary shall remedy its work a
that the Grantor's parcel and improvements shall continue to
be in the condition :they were in prior to the commencement
of the Grantee's work pursuant hereto; all work within the
easement to be underground and in accordance with applicable
laws, codes and ordinances and other governmental requirements
and performed in a good and workmanlike manner using quality
materials.
