CITY 03 BANGOR, MANE Engineering Department November 7, 1985 To the Nunicipal Officers: Reference is made to Cita Council Order No. 85-243 passed June 24, 19857 directing the Oit9 Engineer to do a study to determine the cost of constructing the roads and sewers in the Hemlock Ridge Subdivision on Burleigh Road. Said study request was the result of a petition from Harold D. Johnson, the proposed Developer of the Subdivision. The project will include approximately 2,400 feet of roadway, constructed to a 30 foot width, with 3 inches of bituminous concrete pavement on an 18 inch send and gravel subbase and select gravel base course. All disturbed areas outside of the travel way will be provided with 4 inches of loam and seed. The total estimated cost of the roadway construction is $108,360.00, which amounts to approximately $45.15 per linear foot, which compares favorably to prices received on other similar residential streets. In accordance with City Council Resolve 85-294, which was amended and passed on October 26, 1985, the City would pay fifty Percent of the mad cost, or $547180.001 and the remainder would be assessed against the Developer. The sanitary sewer system would consist of 2,240 feet of 6 inch pipe and 7 manholes, at a total cost of $61,216.00. Of this amount, the City would pay half, or $30,608.00, and the remainder would be assessed against the Developer. The storm sewer system consists of 350 feet of 10 inch pipe, 620 feet of 12 inch pipe, 110 feet of 18 inch pipe, 50 feet of 21 inch pipe, 10 feet of 24 inch pipe, 520 feet of 27 inch pipe, 13 catch basins, 1 drop inlet, 2 retention areas, and approximately 1,600 feet of drainage ditch. The system is more extensive than those found in previous similar subdivisions, since the area on Burleigh Road below this project would receive the stormwater runoff, and the intersection of Burleigh Road and Broadway is presently subject to intermittent flooding. The total estimated cost of the storm newer system is $81,624.00. Of this amount, the City would pay fifty percent, or $40,812.00, and the remainder would be assessed against the Developer. Each of the 30 lots in the Subdivision would be provided with a 4 inch sanitary sewer lateral to the property line, which would amount to the total cost of $9,000.00. The City would not parti- cipate in the cost, which would be assessed to the Developer. Council Resolve 85-294 also provided that the Developer would pay for the coat of street lighting. It is estimated that a total of 8 street lights will eventually be required, at a total cost of $1,600.00, which would be assessed against the Developer. -1- The total project cost is therefore broken down as follows: Item City Developer Total Streets $ 54,180. $ 54,180. $1081360. In accordance with Council Resolve 85-294, the assessments will be deferred for a maximum of three years from the date of City Council acceptance of the final cost report of the City Engineer provided: 1. Prior to assessment the Developer will enter into a written Agreement with the City specifying the terms and conditions of said deferred payment. 2. As each lot is sold the assessment for each lot shall be paid. 3. On the first annual anniversary date of said assessments the Developer shall have paid the total assessment on at least six lots, with a total of at least six more lot assessments to be paid at the and of the second anniversary, and the entire balance to be paid at the end of the third anniversary. 4. That interest at an annual rate of ten percent shall accrue and become a part of said assessments from the date of assessment to the dates of the payment, said interest to be billed annually to coincide with the above-mentioned anniversary dates. 5. Upon any failure to comply with the payment requirements, the City will recover interest at an annual rate of twelve percent from the due date, plus costs, and to otherwise pursue its remedies as provided by law to collect the assessments. The Developer has reviewed all of the cost estimates and conditions as stated above, and has indicated that he is in favor of proceeding with the project under those terms.
