In accordance with 30 M.B.S.A. g 21$6 "The BOCK Basic/National Existing Structures Cade/1984," First Edition, published by the Building Officials & Code Administrators International, Inc., is hereby adopted as the Existing Structures Code of the City of Bangor for Ne purposes of establishing minimum standards governing the condition, maintenance, and rehabilitation of all existing structures: establishing minimun standards governing supplies, utilities and facilities and other physical things and conditions essential to insure that structures are safe, sanitary, and fit for occupation and establishing minimum standards governing the condition of dwellings offered for rent; flying certain responsibilities and duties of owners and occupants of structures, And the condemnation of structures unfit for human habitation and the demolition of such structures. See. 2 Amendments to published Version. "The BOCA Basic/National Existing Structures Cede/1984" is adopted in its published form as if Fully set forth herein, except as follows: (1) Section ES -100.1 is deleted and replaced with the following: ES -1N.1 Title: These regulations shall be known as Me Existing Structures Code of the City of Bangor and are herein referred to as such or as "this code." r2- (2) Section ES-107.5 is amended by the addition of the following sentence: For the purpose of this Section, the terminology "sell, transfer, mortgage, lease or otherwise dispose of" shall include the execution of a land sales contract or similar agreement. (3) Section ES-110.2 is deleted and replaced with the following: ES-110.2 Penalty: Any person, firm, or corporation who Mall violate any provision of this code shall be guilty of a civil violation and subject to a fine of not more than $500 for each violation. Each day that a violation continues shall he deemed a separate offense. All fines collected hereunder shall Inure to the City of Bangor. (4) Sections ES-111.1, ES-111.2, ES-111.2.1, ES-111.2.2, ES-111.2.3, and ES-111.3 are deleted and replaced with the following: ES-111.1 Appeals: Any person affected by aoy notice which has been issued in connection with the enforcement of any provision of this code may request and shall be granted a hearing on the matter before the 'Bangor Board of Appeals", established under Chapter IX, Section 2(11) of the Ordinances of the City of Bangor. All procedures, fees, and requirements for appeals and hearings before the Board under the City Building Code, Chapter I% of the Ordinances of the City of gauger, shall also apply to appeals under this ordinance, the Existing Structures Cede. (5) Section ES-112.4 is deleted and replaced with the following: ES-112.4 Reatralni Actions: Anyone affected by any such order shall within twenty 20) days after service of such order apply to a court of record for an order restraining the code official from razing and removing such structure or parts thereof. The Court shall determine whether the order of the code official is reasonable, am if found reasonable, the court shall dissolve the restraining order, and if found not reasonable, the court shall continue the restraining order or modify it as the circumstances may require. (6) The definitions of "Building Official', "Code Official', and "Enforcement Officer" sustained in Section ES-201.0 are deleted and replaced with the following: Building Official: The Zoning and Cede Enforcement Administration Officer of the City of Bangor. -3 - Code Official: Me Zoning and Code 2nforcement Administration Officer of the City of Bangor. Enforcement Officer: The Zoning and Code Enforcement Atlminis- tration Officer of the City of Bangor. (7) Section ES -301.4 is deleted and replaced with the following: ES -301.4 Insect and Rodent Control: Every owner of a structure or property shall be responsible for the extermination of insects, rodents, vermin, or other pests in all areas of the promises, except that the occupant shall be responsible for such extermination in all areas of the promises of a single-family dwelling. (8) Section ES -601.1 is deleted and replaced with the following: Section M-601.1 Residential Buildinga: Every dwelling unit aM guest room shall be provltletl xith eating Facilities capable of maintaining a room temperature of 68 degrees Fahrenheit at a distance of 3 feet fret the exterior walls and 5 feet above the floor level at an outside temperature of -20 degrees Fahrenheit. (9) Section ES -802.2 is deleted. (10) Section ES�02.4 is deleted.
