HomeMy WebLinkAbout1986-06-09 86-257 ORDER86-257 Introduced by Counci cr Car, June 09, 1986 CITY OF BANGOR (TITLE.) wIiC21BC, Condemnation Ox�len to Acquire., by Zm'nent Domain a Sewer Easement on Property 19osted South of Crosby Street By the CUP Couw l of the City of Ban .- ORDERED, - - THAT, WHEREAS the City Council by Council Order No. 85-235 passed May 28, I9R has authorized the City Engineer to lay out and establish a sewer easement for the extension Of the City Bawer Approximatelstem in a y 325rfeetiSouthofrom Crosbym the Dow Street; adTrunk Sewer located WHEREAS, the City Council has accepted the City Engineer's report relative to the laying out of said sewer easement; and WHEREAS, it is hereby determined that the public exigency requires the immediate acquisition of said sewer easement; NOW, TID ORE, Be It ORDERED By the City Council of the City of Bangor in its capacity as the Municipal Officers of the City of Bangor that the City of Bangor, Maine hereby acquires by eminent domain pursuant 4 30 M.R.S.A., Section 43529 a twenty foot wide sewer easement extending across parcels of land owned by the Webber - Frost land Company as described in Penobscot Registry of Deeds in Vol. 2144, Page 609 and Vol. 2427, Page 231, the location of said sewer easement more fully described as follows; Beginning at an Dow Field Trunk Sews treat, as measured at right angles thereto, and 98 or less, northeast from the southwesterly line of e .and owned by Webber -Frost land Company as described y dlraCtIOn on a east from the sou for a distance of a of said parcel, said easement to be laid out to a width -1- (20) feet, measuring tan (10) feet on either aide of, and at right angles to, the above described line. The purpose of said easement is to permit the City of Bangor or its agents to enter upon the above described properties as necessary to construct and maintain a sanitary sewer within said easement area, including clearing, grubbing, grading, looming, and seeding of the surface. And be it further ORDERED, TBAT the City Council hereby determines that in consideration of damage to the property as a result of said sewer location, that free entry into the proposed new sewer and the existing Dow Field Trunk Sewer where it crosses the subject property will be permitted at me or more points, which is further determined to be just compensation for said easement. And be it further ORDERED, THAT the City Engineer be and hereby is authorised to take all further action as required by law to complete the condemnation and acquisition of said sewer extension by said City of Bangor. -2-
