laying out and establishment of a 2D foot wide easement for the
proposed extension of the sanitary sewer system across property
owned by the Webber -Frost Land Company located south of Crosby
Street be and hereby is accepted; and be it further

Beginning at an existing sewer manhole located an the
existing Dow Field Trunk Sewer, so-called, said manhole located
325 feet, more or leas, southeast from the southeasterly right-
of-way line of Crosby Street and 98 feet, more or lees northeast
from the southwesterly line of said Webber -Frost Land aompsay
property, as described in a Deed recorded in Penobscot Registry
of Deeds in Vol. 2144, Page 609; thence in a southwesterly
direction an a line parallel to, and approximately 325 feet
southeast from, the southeasterly right-of-way line of Crosby
Street for a distance of 98 feet, mora or lees, to said south-
westerly property line, being the northeasterly line of another
Parcel of land owned by Webber -Frost Land Company as described
= a Deed recorded in Penobscot Registry of Deeds in Vol. 242%,
Page 231; thence continuing in a southwesterly direction along
the same course across said Webber -Frust Land Company land for a
distance of 283 feet, more or leas, to the southwesterly line of
said property. Said easement is to be laid out to a width of
twenty (20) feet, measuring ten (10) feet an either aide of, and
at right angles to, the above described line.
The purpose of said easement is to permit the City of Bangor
or its agents to enter upon the above described properties as
necessary to construct and maintain a sanitary sewer within said
easement area, including clearing, grubbing, grading, lamming
and seeding of the surface, upon the condition that the ground
will be restored to its original condition after each entry.
Ho person or parsons appeared at the time and place of the
hearing, although the City Bhgineer had two conversations with
Raymond Cots, representing the property owner, on the day of the
hearing regarding the proposed location of the sewer and its
effect upon their property. He indicated that they are opposed
to the location of the sewer, since they feel that it Could
possibly interfere with the future construction of a building.
It was pointed ant to Mr. Cots that the proposed location of the
sewer was described to Paul Greffam, agent of theproperty owner,
in a telephone discussion on or about October 1, 1985, and he
Agreement was forwarded to bin on December 13, 1985, and when no
response was received, a telephone call was made on January 6,

response was received. Since the Raine Masonry Company, Inc.,
the original petitioner for the sewer extension, has started
the construction of its building this spring and will soon require
sewer service, it is recommended that the sewer easement be laid
out as described and that action be taken to acquire the easement
by eminent domain. In exchange for the easement, it is proposed
that the property owner be allowed the right of free entry into
the sewer at any point along the new sewer or the existing Dow
Field Trun Sewer where it crosses their property, and no further
damages are recommended.
