ORDERED, .
THAT WHEREAS, the City of Bangor and Bangor Development
Associates entered into a Lease Agreement on August 31, 1984,
relative to the lease of thirty (30) parking spaces in the Abbott
Square Parking Lot for utilization in connection with the use and
cupancy of the Schoolhouse Project located at 183 Harlow Street;
and
WHEREAS, both parties found it convenient to enter into a
temporary Lease Agreement on January 16, 1985 for twenty-two (22)
alternative parking spaces in aha upper, northeasterly, section of
the so-called Atter Parking Lot until improvements to the Abbott
Square Parking Lot were completed; and -
WHEREAS, Bangor Development Associates has indicated a
preference to continue leasing, for the duration of the original
Lease Agreement dated August 31, 1984, the twenty-two (22) parking
spaces temporarily leased in the upper level of the Atler Parking
Lot and eight (8) parking spaces in the Abbott Square Parking Lot
instead of having all thirty spaces located in the Abbott Square
Parking Lot; and
WHEREAS, the transfer of the location of twenty-two (22)
of the thirty (30) parking spaces from the Abbott Square Parking Lot
to the Atler Parking Lot will involve nincrease n the number of
parking spaces leased to Bangor Development under the
terms of the original Lease Agreement dated August 31, 1984:
NOW, THEREFORE, BE IT ORDERED THAT the City Manager i
hereby authorized toexecute an Amendment to Articles I and III of
the Lease Agreement by and between the City of Bangor and Bangor
Development Associates dated August "31, 1984 as follows;

PREMISES

The City, for and in consideration of the rents to be
paid and the obligations to be performed by the Lessee as herein-
after provided, does hereby demise and lease unto the Lessee, and
the Lessee does hereby demise, lease, take and hire, upon and
subject to the conditions hereinafter expressed, the following
described property in its present condition, viz.

ARTICLE III
RENTAL
The rental to be paid by the Lessee to the City during
the term of this Agreement for the Minty -(-3 twenty-two (22)
spaces identified on Exhibit A and the eight (8) spaces is ntl fieri

RE': Proposed Amendment to Council Order 86-250
Council Order 86-250, "Authorizing Amendment to Lease
Agreement for Parking Spaces - Schoolhouse Project", proposes an
amendment to Articles I and III of the lease agreement between the
City and Bangor Development Associates dated August 31, 1984. The
terms of this agreement are included in another agreement between
the City and the Department of Housing and Urban Development
relating to the Schoolhouse -Abbott Square UDAG grant. An amendment
to the agreement with Bangor Development Associates will require an
amendment to the agreement with HUD.
Therefore, it is recommended that Council Order 86-250 be
amended as follows:
"NOW, THEREFORE, BE IT ORDERED THAT the City Manager is
hereby authorized upon r ing [he written concurrence of the
Department of Housing andcUrban Development, to execute an Amendment
to Articles I and III of [he Lease Agreement by and between the City
of Bangor and Bangor Development Associates dated August 31, 1984 as
follows:"
