ORDERED.
THAT the attached report of the City Engineer showing the actual
cost of extending the sanitary sewer approximately 11400 feet north
from the Broadway Lateral Sewer be and hereby is accepted; and be it
further
ORDERED,
THAT the assessments be deferred as noted therein, and that a
refund be made to the Bangor Baptist Church covering the balance of
their initial deposit for the sewer extension.

To the Municipal Officers:
Reference is made to City Council Order No. 81-285 passed
September 28, 1981 which authorized the extension of the sanitary
sewer in a northerly direction an Nenduskeag Avenue from the
Broadway Lateral Sewer, as the result of a petition from the
Bangor Baptist Church. All work has been completed, consisting
of the installation of 1,400 feet of 8 inch sewer and five
manholes.
The actual coat of the sewer installation was $33,230.00,
which compared favorably with the original estimated coat of
$392750.00. In accordance with the original agreement, the
City would pay fifty percent of the coat and the remaining amount
would be assessed proportionately against the properties bene-
fitted, as follows:

The non -assessable shares indicated above are the result of
the previous extension of the Broadway Lateral Sewer across the
subject properties, for which free entry into the sewer was
granted by the City in exchange for sewer easements; accordingly,
the pro rated assessments would be paid by the City.
All of the above listed property owners were originally
opposed to the sewer extension, except for the Bangor Baptist
Church, the original petitioner. The original Council author-
ization to construct the sewer provided that the Church would
prepay the total private share, and that the assessments against
the properties of those opposed would be deferred until sewer
entry is requested, with simple interest charged at the rate

of twelve percent (12%) for the first ten years, or until sewer
entry is requested, whichever is leas. At such time as any of
those owners with deferred assessments desire to enter the sewer,
then the assessment, plus interest, would be paid, and eighty
percent (80%) would be reimbursed to the Bangor Baptist Church.
The original prepayment by the Bangor Baptist Church amounted
to $16,000.00. Since the total private share was $13,486.00, e
refund of $2,514.00 should be made to the Church. It is recom-
mended that the remaining assessments be deferred until sewer
entry is requested under the conditions described above provided
that a suitable Subordinate Agreement is executed by the property
owners whose assessments are to be deferred.
Plane showing the actual sewer installation are on file in
the office of the City Engineer.
