ORDERED,
THAT Hobert Burke, Chief, Bangor Fire Department, ishereby
authorized and directed, on behalf of the City of Bangor, to execute
Mutual Aid Agreements, the form for which is on file in the Office
of the City Clerk, with the municipalities of Brewer, Hampden,
Marmon, Glenburn, Veazie and Orono.

IAI{VAL AID AGREEMENT
MFEPNEMf made this _ day of , 1987, by and
between the CITY of 84M(YM and the hoth municipal
corporations located in the County of Penobscot, State of Maine.
W ESSFIR:
YIHEReAS, by virtue of 30 M.R.S.A. 5 3777 the parties by their
Municipal Officers my authorize their fire drepartents to aid in
extinguishing fires in other municipalities;
f , 19EgEFDCE, pursuant to 30 M.R.S.A. 5 3777, the parties by their
Municipal Officers hereby resolve that their fire departnents a.m authorized
to give such aid, and in furtherance Of this resolve, the parties agree as
follows:
(1) In the event that in the judgnent of the Fire Chief or other
officer in charge of the fire department of either party, a fire or other
mangency is occurring or is about to occur in his municipality of such
magnitude that it cancrt he alaluetely controlled by local firefighting
eguipoent and personnel, said officer may call on the other party's fire
departnent to furnish available firefighting aguiprent and per"nel for use;
either (1) in coobatting the fire or other ea:ergency, or (2) as a standby
reserve to meet all other calls that may occur before the local firefighting
force is free to take care of them.
(2) Upon receipt of such a call, the aiding fire department shall
furnish such equipment and personnel as may be available for the stricken
municipality except that said aiding fire department shall always he permitted
to retain sufficient firefighting equipment and personnel to fight any fire or
meet any emergency within its own boundaries that may he reasonably
anticipated.
(3) whenever either fire deparinwwht responds to a fire or emergency
in the other municipality, all companies shall report to the Chief or other
incident contender of the municipality requesting aid and receive an
assignment. The aiding fire department shall cperats under the direction of
the thief or incident oamaMer of the requesting Rmmicipality until
dismissed. fact individual company shall operate under the immediate
supervisimi of its am officers.
(4) a. each party is resporeible for damage to and less of its own
equipnen[, except for damage or loss caused by the negligence or fault of the
other party.
b. Each party will provid0 Workers' 000@en64tion insurance to
cover its own personnel for compensable injuries arising out of aid rendsreG
under this Agreement Eaoh party will maintain sufficient liability irmurance
on its vehicles and other liability insurance consistent with the limits on
liability in the Maine Sort Claims Act.
c. Each party will be responsible for the legal censaquence of
its own negligence to the extent provided by law. It is understood that any
liability to third parties caused by the negligence or fault of the incident
commander or chief of the community requesting aid, shall to that extent he
the reaporeiblity of the commmity requesting aid.
(5) Services performed by either party to this Agreanent SM11 be
renderer] without cost or reimbursement to such party; provided, however,
nothing herein shall prevent either party from seeking and receiving
reimbursement for the costs of fighting forest fires under 12 M.R.S.A. 55 9201
at seq.
