deleted in its entirety and replaced with the following:

Sec. 1 Mechanical Code Adopted. In accordance with 30 M.R.S.A. 5 3156,
the BCCA National Mechanical Code/1987,
sixth Edition, published by [le Building Officials ani CWe Admin-
istrators International, Inc., is hereby adopted and
inmrporated by reference, as the minimum stze a for the
design, installation and maintenance of all aechanical systems
in the City of Bangor', including heating systems, ventilating
systems, ocoli g systems, steam aW bot water heating systems,
Process piping, boilers and pressure vessels, appliancas
utilizing gas liquid or solid fuel, chimays aW vents,
mechanical refrigeration systems, fireplaces, baehecues,
imineratons, ctmetories, fire protection systems and air
pollution control systema. said Mechanical Cole is adopted in
its publishei form ae if fully set forth herein, except as
follow:
(1) Section M-100.1 is amended to read as follow:
M-100.1 Title: This Cede shall be known as the Mechanical
Code of the City of Bangor hereinafter referred to as the
Mechanical Cede or "this Cede."
(2) Section M-109.1 is deleted in its entirety and replaced
with the following:

(3) Section M-109.2 is deleted in its entirety.
(4) Section M410.8 is deleted in its entirety.
(5) Section M-111.3 is mnended to read as follows:

(8) Section M-117.4 is deleted in its entirety and replaced
with the follcmieg:
M-117.4 civil Penalties: The requirements of 30
M.R.S.A. S 4966 shall apply W the dete®instim of
penalties for violations of this Ordinance. 1be
minimm penalty for a specific violation of this
Ordinance shall be $100 and the maxinm penalty shall
be $2500; provided, however, the maxims penalty
may, exceed $2500, Wt shall not exceed $25,000 when
it can be shown that there has been a pervious
conviction of the same party within the past 2
years for violation of the same Ordinance provision.
(9) Section P 118.2 is amended W read as follows:
M-118.2 Unlawful Continuance: Any person who shall
continue any work i about the structure after
having been served with a Siva work Order, except such
work as that person is directed to perform W ramove a
violation or unsafe erudition, shall be guilty of a
violation of this Ordinance.
(10) Section M-122.0 is deleted in its entirety and replaced
with the following:
M-122.0 Appeals: An appeal may, be taken firm any
order, decision or other action of the Cade Official
W the Building Burd of A{ als (hereinafter called
the •toard") established by chapter IX, Section 124
of the laws 5 Ordinances of the Qty of Bangor. the
appeal moat be filed in writing with the Director of
Cada Enforceaent 6 Fire Prevention within 30 days of
receipt of said written notice. She Board may interpret
this Code and thereby affirm or modify such ordar; o
may grant exceptions therefrom when practical difficulties
or unnecessary hardships exist, and it is clearly evident
that reasonable safety would thereby be secure9. the
actions of the Board shall be governed by the provisions
of Chapter IX, Section 124, et seq. Failure of the Board
W issue a written notice of its decision within 30 days
after the hearing of the appeal constitutes a danial of
said appeal. Further appeal from the decision of the
Board of Appeals may be made to the Soperice Court in
accordance with the Maine pules of civil Procedure,
Bole BOB.
