ORDERED,
THAT the City Manager is hereby authorized and directed, on
behalf of the City of Bangor, to execute an. Amendment, a copy of which
is on file in the office of the City Clerk, to the existing Contract.
between the City of Bangor and Sawyer Environmental Recovery Facilities,
Inc., dated September 10, 1984, for purposes of extending the term of
said Contract until February 1, 1988 or the date that Penobscot
Energy Recovery Company (FERC) is able to receive solid waste
materials from the City.
Statement of Fact: The purpose of this Amendment is to finalize
the Agreement by Sawyer Environmental Recovery Facilities, Inc. to
extend the term of the existing Contract for the disposal of solid
este materials to Such date that PERC's facilities in Orrington
go on line and are able to receive solid waste materials from the
City of Bangor.

Council Order k87-275 - Solid waste Contract
Representatives of Sawyer Environmental FeGovery Facilities, Inc. have
requested that the larguage In the proposed Amendment relating to the "Genn"
of the agre®ment be ananded. Under our current proposal, its, expiration
date is determined by the City Etgineer as the date on which PEFIC is ready
and able to accept solid waste materials from the City. Representatives of
Sawyer Environmental have asked fast the expiration date be keyed to the
date PEW notifies the City it is nearly and able to take .solid waste
materials. 'this date is established under the existing Agreement between
PERC and the City of Bangor, dated July 10, 1905. I have ro objection to
their request. therefore, I ask that Paragraph 1 of the proposed Amendment
be modified to read as follows:
"1. term. Midnight Septanber 10, 1987 to the date the PenoteCot.
Energy Recovery Company (PEW) is ready and able to accept all
wild waste materials from the City of raper; said date to be
determined by PM in accordance with its Agreement with the City.

Of Penobscot, State of Maine ("SERF")
WITNESSETH:
NXERE4S, by Disposal Facility Agreement, dated September 10, 1984,
the parties agreed to use SERF's Disposal Facility for disposal of its
saru Cipal solid waste for a term expiring on September 9, 1987; and
WHIUSM, the parties hereto wish to amend said Disposal Facility
Agreement to extend the tens until February 1, 1988 or the date that the
Perobsoot Energy Recovery Company (PERC) is ready and able to receive
materials from the City of Sangor,
Now, MEREFUEE, the parties do mutually agree as follows:
(1) THAT Paragraph No. 1 to deleted in its entirety and replaced
with the follwi g:
1. Term. Midnight September 10, 1987 to the data
the Penobscot Energy Recovery Coopany (PEaC)
is ready and able to accept all solid waste materials
from the City of Bangor; said data to be detamined
by the City Rngineer.
(2) THAT Paragraph M. 2 be deleted in its entirety and replaced

in

entirety.
(4) THAT except for tte foregoing, said Disposal Facility

Environmental Recovery Facilities shall ranain in full force and affect in
all other respects between the urAersigred.
