M-1540(2)/PIN 2664.00 AND FEDERAL AID PR0.1EG4 NO. M-1510(2)/PIN 2666.00 This AGREEMENT is aade this day of , 1987, by aM between the STATE OF MAH acting by aM throughits Department: of Transportation, hereinafter referred to as the State, and the CITY OF BANOR, in the County of Penobscot, a body corporate and politic, hereinafter referred to as the City; Witnesseth, that WHERCIS, the State is planning to install now traffic signals at the intersection of Obio arta Griffin Streets and at the intersection of Stillwater Avenue ardi Essex Street in Bannon, aad; WHEREAS, the City agrees such work is desirable and necessary; NOW THEREFORE, the Parties agree as follows: I. To award the necesspry contracts to install new controllers and replace the existing flashing beacons with new traffic signals on wood poles ad span wire at the intersection of Ohio and Griffin Streets under Federal Aid Project No. M-1540(2) ad at the intersection of Stillwater Avenue and Essex Street oder Federal Aid Project M. M-1510(2), all hereinafter referred to as the project, which is more particularly described ou the plans ad in the specifications prepared by the State. B. To acquire and pay for my property rights deemed necessary for the project. C. TO provide pavement markings and traffic control signs as necessary on a first-time basis. II. AD the City gees to the following: A. To approve And does hereby approve the work contemplated under Federal Aid Projects No. M-1540(2) and M-1510(2) as described oder Section I, Paragraph A above. B. TO pay all of tie nen-federal share of the additional mats resulting from any Extra Work orders or Change Orders initiated by the City by notifying the State's Construction Division representative in writing of the willingness to pay the met for all additional work and to make reimbursment as follows: 1. In the event that no federal participation is approved for the additional work, the City shall pay the entire additional cost for such work. 2. In the event that federal participation is approved, the City shall pay only the nod -federal share of the addition cost for such work. To assume all maintenance and operational costs for the traffic signals and all related equipment W be installed as a pert of this project as bereinbefore described other Section I, Paragraph A, aM further: 1. To expeditiously correct or repair all deficiencies or malfunctions in the signal systems as required. 2. To preserve the visibility of the signals by causing all visual impairments to be removed. 3. To make the traffic signals and all related equifinent when reanved and replaced the Property of the State without cost W the State. 0. To maintain pavement markings and traffic control signs as necessary. E. To prohibit parking along Stillwater Avenue and Essex Street as follows: 1. Along both aides of Stillwater Avenue each side of its intersection with Essex Street for a distance of 130 feet. 2. Along both aides of Essex Street northerly of Stillwater Avenue for a distance of 100 feet.
