By the City Comair of the City of Bagger. ORDERED, TELAP the City Manager be and hereby is authorized on behalf of the City Council to accept the Proposal dated December 6, 1966 from Cornish 6 Silva, Inc., Golf Course Architects from Amherst, Massachusetts, for the final design and inspection of the proposed 9 -hole expansion of the Municipal Golf Course, a copy of said Proposal being on file in the Office of the City Clerk. STATEMNT OF FACT: The total cost of the design and inspection work is $21,000, less a credit of $3.000 for preliminary design work previously completed and paid for. Couneflman PROPOSAL FOR GOLF COURSE DESIGN SERVICES 9 HOLE ADDITION BANGOR MUNICIPAL GOLF COURSE Cornish and Silva, Inc. Golf Course Architects Fiddlers Green Amherst, Mass. 01002 Dec. 6, 1986 Cornish and Silva, Inc. propose the following services for the 9 hole addition at The Bangor Municipal Golf Course. I.- Preliminary visit ( previously billed and paid $500 2. Preliminary Plan (previously billed and paid 1 2,500 3. A revised preliminary plan together with discussions with all concerned and a final pEeliminary 11000 4. Clearing plan t0 show widths of clearing on 9 hole addition together with clearing specifications. It may be advisable to contract this work to local people. In fact we often get it done for nothing in return for the timber, pulp and chips 1,000 S. Detailed plans and specifications for bidding the work 17,500 6. Bidding phase and assistance in selecting the contractor 11000 J. Fifteen visits of inspection during construction @' $500. ( Planning visits are included in item #4 ) 7,500 Total ( Including $3000 previously billed & paid ) $21,000 The foregoing would be billed and payable as follows. Item 1. -Previously billed and received Item 2. Previously billed and received Item 3. Upon completion of this item Item 4. Upon completion of this item Item 5. One half when we are authorized to proceed and one half upon completion. Item 6. Upon completion Item ]. Billed monthly in accordance with the number of visits made that month. If for any reason the work is stopped permanently the Owner would be responsible to Cornish and Silva, Inc. only for services complete by the Time we are so notified. Cornish and Silva. Inc. would not proceed with any phase without authorization from the City Engineer. - 2 - Although our services are among the most complete of anyones there are several limitations which we•.would like to bring to your attention at this time in order to avoid any misunderstandings in the future. 1. All structure such as bridge, shelters and cart paths are not planned by us although we will help site them if asked to do so. 2. Procurement of permits and all other necessary authorizations from all applicable authorities for all phases of construction and future maintenance are to be obtained by the City not us. We cooper- ate in any way we can. The City not the golf architect is also re- sponsible for deterring what is needed in regard to permits and per- missions. 3. Visits of inspection. We provide regular visits of inspection as mentioned heretofore. These are made by BrianSilva or me. We attach the highest importance to this phase of our work. However, because misunderstandings can arise as to what these visits consist of I have excerpted the attached section from an A.I.A. document. If " golf course architect" is substituted for the work "architect" this section will describe our visits of inspection. 4. Storm drainage and Dams and Impoundments. These are not our responsibility. Storm drainage includes water running onto the site from the property of others, the increased runoff from the future condo- miniums and roadways and the water running off the property onto the property of others. It also includes all forms of pollution, sedi- nebtation and siltation resulting from construction and maintenance of the golf course. In constructing the ponds it may be necessary to plan dams or impoundments with overflows and also pipes for connect- ing the ponds. Settling and sediment ponds may also be required.. Although we plan the configuration of the golf course ponds ( not the settling and sedimentation ponds ) we do not plan or draw up specifications for them or any" of the items listed in the fore- going paragraph. 5. The City is to stake the centerlines of the fairways as per the clearing plan and flag clearing limits 6. We will inform the owner of types and amounts of insurance some Towns and Cities use for golf course construction. We will not however, be responsible�for determining what the City of Bangor actually needs. 1 trust this is the information you need but that you will contact me if It is incomplete in any Way. -1 GC/pd epffY Cornish VISITS OF INSPECTION Visits after Construction starts will be made in accordance with the following. The Designer will visit the site at intervals appropriate to the stage of construction to familiarize himself generally with the progress and quality of the Work and to determine in general if the Work is proceeding in accordance with the Contract Documents. However, the Designer will not be re- quired to make exhaustive or continuous on-site inspections to check the quality or quantity of the Work. On the basis of his on-site observations as the Designer, he will keep the Owner informed of the progress of the Work and will endeavor to guard the Owners against defects and deficiencies in the Work of the Contractor. The Designer will not be responsible for and will not have control or charge of construction means. 'methods. techniques, sequences Or procedures, or for safety precautions and pro- grams in connection with the Work. and he will not be respon- sible for the Contractor's failure to carry out the Work in accordance with the Contract Documents. The Designer will not be responsible for or have control or charge over the acts or omissions of the Contractor. Subcontractors, or any of their agents or employees, or any other Persons performing any of the Work."
