THAT Chapter XII, Article 4 of the Laws. and Ordinances of the City of
-Eangor be amended by adding the following:

AND THAT Chapter XII, of the Laws and. Ordinances of the City of Bangor
shall be amended by the addition of the following Article:
ARTICLE 5A SITE LOCATION OF DEVELOPMENT. ACT APPROVAL

1.1 Submittals. Applicant shall submit an application
andfour -d4)-ppies ofall plans. and
supporting materials to the City of Bangor Planning
Office.
1.2Development Standards. Applicants shall meet the
.standards of. M.R.S.A., Title
38, Sections 481-489, as. amended.
1.3 Upon receipt of a complete application and filing
fees the Planning Division Staff shall forward a
copy of theapplication to. the Department of
Environmental Protection.
1.4 The Planning Division Staff will have fourteen (14)
days to review the completed application and make its
recommendation to the Planning Board.
1.5 The Planning Staffshall notify in writing all
property owners of record within one hundred feet
of the proposed subdivision.
1.6 If it deems it necessary, the Planning Board will
hold a public hearing on the proposed subdivision
at the next regularly scheduled meeting not more
than thirty (30)days nor less than fourteen (14)
days from receipt of a completed application.
Within twenty-one (21) days of Planning Board review
or a public hearing the Planning Board will approve
approve with conditions or modifications, or disapprove
the proposed subdivision unless the applicant and the
Planning Board shall agree mutually to an extension of
such time period to allow further time for revisions
and resubmittal of application materials.
1.7 The Planning Staff shall publish notice of any
required public hearing in a newspaper of general
circulation at least ten (10) days prior to such
public hearing before the Planning Board.
1.8 The Planning Division Staff shall notify the applicant
n writing of the Planning Board decision and shall
forward copies of the application,the permit, and
the Planning Board's decision to the Board of Environ-
mental Protection by Certified Mail.
1.9 No approval granted by the Planning Board under this
section shall become effective until thirty (30) days
subsequent to its granting, as the Board of Environ-
mental Protection may deny or modify such applications
within this thirty day period.
1.10 Approval of a subdivision under this section does not
constitute subdivision approval under those provisions
of this ordinance fulfilling the requirements of 30
M.B.S.A. §4956.
1.11 In the event that applicant's request is denied by
either the Planning Board or the Board of Environmental
Protection the applicant may request a hearing before
either of the above with reasonable public notice
given.
