Meaning and intending to discontinue that portion of Jackson
Street lying between the northeasterly right-of-way line of
Highland Avenue and the southwesterly right-of-way line of Summit
Perk, and noting that the name of Summit Park has been changed to
Thomas Hill Road by City Council Order No. 86-422 passed October
27, 1986.
There apyeared at the time and place set for the meeting Dr.
and Mrs. Charles MoEvoy of 51 Highland Avenue, Stuart Tinker of
25 Jackson Street, and David Fuller of 83 Highland Avenue. The
City Engineer explained that the street was being discontinued
at the direction of the City Council on the basis of a petition
received from a majority of the property owners on Jackson Street
and Highland Street, which would permit the renaming of the north-
easterly and of Jackaon Street, Summit Park, and all of Highland
Street to Thomas Hill Road. It was noted that the property along
the northwesterly side of that portion of Jackson Street to be
discontinued is owned by the Bird Conservation Club of Bangor
described in Deeds recorded in Penobscot Registry of Deeds in
Volume 995, Page 322 and in Volume 1007, Page 398, and the property
clang the southwesterly side consists of 150 feet owned by Phyllis
Fuller described in a Deed recorded in Penobscot Registry of Deeds
described in a Died recorded in Penobscot Registry of Deeds in
Volume 1538, Page 239, and 147.70 feet owned by the City of Bangor
and occupied by the Standpipe described in Penobscot Registry of
Deeds in Vol. 664, Page 359•
In accordance with 23 M.R.S.A. 3026, the City would retain a
public easement for any existing utilities within the right-of-way,
and the remaining interest would pees to the abutting property
owners to the center of the way. The City Engineer also recommended
that no damages be paid as a result of said discontinuance, since
the street serves no useful purpose to the public or to the abutting
property owners. The City Engineer indicated that he would recommend
that large boulders and suitable signs or barricades be placed at

either and of the portion of the street to be discontinued, and
that plowing or other maintenance be discontinued, with the pave-
ment to be removed and the area loomed and seeded next year.
The Planning Hoard at their meeting on Monday evening,
November 17th, voted not to remove the section of right-of-way
to be discontinued from the Official City Map, apparently being
unaware of the reason for said street discontinuance; however,
the City Engineer recommends that the street be discontinued
and removed from the Official City Map on the basis of the
petition from the majority of the property. owners on Jackson
Street and Highland Street, and because the section of Jackson
Street between Highland Avenue and Summit Park is not public.
