Commentary:
"a purpose of this Ordinance FmeraMent is to replace the three separate
ordinances on prwMrokers, dealers in old gold and silver, and dealers in
secvadhald articles with one comprehensive ordinance regarding such business
activities in the City of Hanger.. The Breast City Manager, Braver Police
Chief std Brewer City Bolfcitor have met with us to discuss this scatter and it
is anticipated that Braver will be adopting an identical: ordinance in the
immediate future. the essence of this Orinance is to impose more stringent
reporting requirements on dealers in ussi personal property and W require
mandatory holding particle. The anticipated resultis that the Police will be
better able to track dawn stolen articles wlaicia: often pas through these
establishments.
The Council should be movie .aware that. Brewer officials have
suggested that we Ugly, vent to include an exemption for antique ,dealers.

THAT Chapter -N, Articles 3, 4 and 5 of the Ordinances of the City of Bangor
e hereby repealed in their entirety and replaced with the following Article
3:
Sec.1 Definitions
(a) pawnbroker: any person, firm or corporation engaged in the
business of iawnbroking for which a license is
required under 30 M.R.S.A. 5 3151.
(b) Dealer: any person, firm or corporation engaged in the
business of purchasing, selling or trading used
personal property.
Sec. 2 Licenses Required. Mo perms , firm or corporation shall engage i
pawnbroking or dealing in used personal property
in the City of Bangor except under a written ron-transferrable license
granted by order of the City Council. Such license shall be granted
for a period of ane (1) year, unless sooner terminated as provided
herein. The fee for such license shall be Fifty ($50.00) Dollars.
Sec. 3 Records Required.
(a) Every pawnbroker and every dealer shall record the following
information prior to accepting any property in pan or
purchasing any used personal property:
(i) the date of thepawnor purchase;
(ii) the poner1a or seller's name and address as
verified by written proof of the pawner's or
seller's identification in the form of a valid
motor vehicle operator's license or military
identification card;

of Pawnbrokers and dealers in used Personal Property
(iii) a detailed description of the property, inclnding but not limited to, the name of the manufacturer;
the model; serial munbers and any other identifying
codes or lettering; any engravings of initials,
bases or identification marks; any and all copyright
information such as bases of artists and titles;
color end type of material; and approximate size and
weight of all jewels or precious metals.
(b) Every pawnbroker and every dealer shall record the following
information prior to the sale of any property encs bell in
pawn o any used personal property which he has purchased for
resale: I -
(i) the data of the sale;
(ii) the purdraser's name and address as verified by
written proof of the purchaser's identification in
the form of a valid motor vehicle operator's license
or military identification card;. -
(iii) a detailed description of the property, including
but not limited to, the name of the manufacturer;
the model; serial umbers and any other identifying
codes or lettering; any engravings of initials,
names or identification marks; any and all copyright
information each as names of artists and titles; -
color end type of material; and approximate size and
weight of all jewels or precious metals. -
Sec. 4 yorm of bamrds. The records required under Section 3 shallhe
recorded and maintained on consecutively-nimbeied
receipts in order by date oftransaction, or in a bound voluneor -
ledger or in a binder in which pages can be affixed.' -
Sec. 5 Availability for Inspection. Every pawnbroker and every dealer shall
maintain the records required under.
Section 3 and shall allow any law enforcement officer of the City of .
Bangor to inspect such records ups demand during regular business
lours.
Sec. 6 peporting Begaired. rveiy pawriroker and every dealer shall deliver
true and accurate copies of all records required -
under Section 3 to the Bangor Chief of Police within seven (7) days,
excluding Saturdays and Sundays, after the coopletion of the
transaction for which such record has been made. -

Mo. J Holding perp. In addition to any statutory requirements, n0
personal property any be re -sold prior to the
expiration of seven (7) days, excluding Saturdays and Sundays, after
the records required under Section 3 have been delivered to the
@ief of Police as required under Section 6. During such time the
property shall be maintained in the sane condition as of the date of
purchase.
Sec. 0 SeverabilitY. Each of the provisions of this Ordinance are severable,'
and if any provision shall be declared to be invalid o
void, the regaining provisions of this Ordinance shall not he affected
and] shall ranain in full force and effect.
Sec. 9 Viclations. My pawnbroker or dealer in used personal property who
violates any section of this Ordinance shall pay a fine
Of not less than One Hundred ($100.00) Dollars nor mre than GO
ThCUS nd ($1,000.00) Dollars, and such pawnbroker's or dealer's
license shall be terminated.
