THAT Chapter XII, Article 5, Section 1. --'Definitions be amended by
adding the following: ..
1.11 Planned Development. A. development of two or more building
wTirc ase in
common mon ownership and/or provides for an owner's
association which states the responsibility for maintenance
of roadways, utilities and other facilities provided that:
a) All portions of the site are accessible to a
public street. or proposed public street
b1Access to any required parking areas is available
c) Access to common areas, including required yards
and open space is available.
1.12 Water Service. A subdivision or planned development shall
be�eemedto have water service i£ any part of the sub-
division or development is within 500 feet of any existing
water line.
1.13 Sewer Service. A subdivision or planned development shall

would connect via gravity flow and no pumping is required.
1.14 Developmental SuHivLsi2n. -A subdivision in which no lots

THAT, Chapter X11, Article 11, Section 1.3.2 be amended as follows:

NOTE: Additions are underlined.
AND THAT Chapter XII, Article ], Section 1 - Procedure for Approval
of Final Plat be amended by adding the following:
Planned Develd tints. Applicant shall submit full docu-
entation'o a in rng commLument to the ownership
association which shall be provided in a recordable form
as determined by the City Solicitor's Office.
AND THAT Chapter XII, Article 9, Section 1 - Preliminary Plat and
Contents be amended by adding. the following:
The plat shall note the existence of an ownership
association if applicable and that the City of. Bangor
bears no responsibility of the operation and maintenance
of streets and utilities.
AND THAT Chapter XII, Article. 10, Section, 1 - Final Plat and Contents
be amended by adding the following:'
Subdivision approval by the. City _shall be conditioned upon
the recording of the approved subdivision plat
In the case of a planned development such: approval shall be
subject to the recordingof the owners association document
provided in Article 7, Sectioa. 1.314.
AND THAT Chapter XII, Article 'll, Section 1.3 -'bots be'amended by
deleting,Section 113.2 in itsentiretyand replacing it: with the following:
Frontage. At. least one side of every lot shall. abut on
a public street, proposed public: street, or inthe case
of a planned development lots must abut on a public street,
a proposed public street, or private street or a proposed
private street.
AND THAT Chapter XII, Article, ll, Section 1 5 ItilftJEasements. be
amended by deleting it in its entirety. and replacing it writ —tT
following:

as well as ahy planned development as described in
this Ordinance shallbe provided with public sewer
service from the. City of Bangor's system and with
public watereom ice frthe Bangor Water District
system if such lot or group development is located
within 500 feet of an existing service main of such
public utility.
1.5.2 Utility Easements. The Planning Board may require
ents for utilities, if necessary to provide
service to proposed subdivisions8
1.5.3 Bxc eptiona. The requirements of 1.5.1 above may be
ved, far the convenience of the City of Bangor (in
the case of sewerage) or of the Bangor Water District
(for water service) if the respective utility
provider finds that it is not in its best interest to
have such service extended. The City Manager shall
determine that sewer service should not be extended
and the Water District Superintendent shall determine
that water service should not be extended.
AND THAT Chapter XII, Article -12, Section 2 - Utilities be
amended by adding the following:
2.8 Subdivisions or planned developments i which there i
either water service or sewer service applicant shall
demonstrate the feasibility of providing on-site water and
sewage disposal.
