Summary
This Ordinance will amend Chapter 165 of the Land Development Code to rezone approximately 1.01 acres of
land located at 117 Broadway from Multifamily & Service District to Government & Institutional Service District.
The zone change will allow the applicant to use the existing office building on the property as medical office,
which is a conditional use in the proposed district.

ORDINANCE, Amending Chapter 165, Land Development Code, Zone Change — Changing a portion of the
property at 117 Broadway (Tax Map 048-151) from Multifamily & Service District (M&SD) to Government &
Institutional Service District (G&ISD).
WHEREAS, the Comprehensive Plan of the City of Bangor has identified this property as suited for high
density residential use; and
WHEREAS, the property contains an existing office building which was in use on the site for many years; and
WHEREAS, the applicant, Broadway Medical Arts, seeks the rezoning in order to utilize the existing building
as medical office, via a Conditional Use permit;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT
That the zoning boundary lines as established by the Zoning Map of the City of Bangor dated October 28,
1991, as amended, be hereby further amended as follows:
By changing the zoning of the property located at 117 Broadway (Tax Map 048-151) from Multifamily &
Service District (M&SD) to Government & Institutional Service District (G&ISD), said parcel of land containing
approximately 1.01 acres and being more particularly indicated on the map attached hereto and made a part
hereof.
PROVIDED, HOWEVER THAT, in addition to the mandatory conditions imposed by Chapter 165-7 of the
Ordinances of the City of Bangor, said change of zone is granted subject to the following conditions:
1. The minimum lot area for the property shall be at least 1/2 acre.
2. The height of any builidings on the property shall be limited to a maximum of 40 feet.
3. The imprevious surface ratio for the property shall not exceed 0.75.
4. The sole access or driveway onto the property shall be from Pine Street; there shall be no
direct access from Broadway.
5. The buffer yard along the rear side yard of the property along Broadway shall be a "B" buffer
yard and the parking buffer yards along Pine Street and Somerset Street shall, as much as
possible, conform with "A" buffer yards.
6. The provision of food on premises shall be limited to tenants, building occupants, and/or their
staff.

7. No overnight accomodations shall be provided on the property.
8. Execution by those parties with an interest in the affected property of an agreement providing
for the implementation and enforcement of all the terms and conditions set forth above and
the recording of said executed agreement in the Penobscot County Registry of Deeds by the
property owner. In the event that said agreement is not so executed within ninety (90) days
from the date of passage hereof, this Ordinance shall become null and void.
