Summary
This ordinance amendment is a proposed rezone of 0.44 acres (19,166 square feet) of land on
French Street from Urban Residence 2 District (URD -2) to Multifamily and Service District (M&SD).
The Applicant, RSQ, LLC, seeks to rezone the two parcels on French to allow operation of a Bed &
Breakfast Establishment and related parking.

ORDINANCE, Amending Chapter 165, Land Development Code, Zone Change — 194 and 200 French Street
(Tax Map 49 Lots 8 and 9) from Urban Residence 2 District (URD -2) to Multifamily and Service District (M&SD).
WHEREAS, The Comprehensive Plan of the City of Bangor has identified this property as High Density
Residential; and
WHEREAS, the existing parcels at 194 and 200 French could support a B&B establishment in M&SD; and
WHEREAS, RSQ, LLC, seeks to rezone two parcels to accommodate the B&B and related parking;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT
Chapter 165 of the Code of the City of Bangor is amended as follows:
The zoning boundary lines as established by the Zoning Map of the City of Bangor dated October 28, 1991, as
amended, be hereby further amended as follows:
By changing two parcels of land located at 194 and 200 French Street (Tax Map 49 Lots 8 and 9) from Urban
Residence 2 District (URD -2) to Multifamily and Service District (M&SD). Said parcels of land containing
approximately 0.44 acres (19,166 square feet) and being more particularly indicated on the map attached
hereto and made a part hereof.

Please be advised that the Planning Board at its meeting on November 6, 2018, held a
Public Hearing on the above zone change request.
Chairman Charles Boothby opened the public hearing and asked the applicant or their
representative to present their request. Ed Bearor of Rudman - Winchell spoke, representing the
applicant, RSQ, LLC. Mr. Bearor explained that the applicant wished to rezone the property in
order to operate a bed & breakfast in the historic building located at 194 French Street, with
parking located on the vacant parcel at 200 French Street. Mr. Bearor noted that this was an
allowed use in the district and that the proposed use would not disrupt the character of the
neighborhood, as there are a variety of uses on the block including medical office, religious
buildings, multifamily housing, and others. Mr. Bearor noted that the property was bordered on
two sides by Downtown Development District zoning, and multifamily housing on the other side.
Chair Boothby asked for any proponents or opponents to the application; there were none.
Member Brush asked Planning Officer Gould about for details on the legal definition of a
bed & breakfast", and if said use required owner -occupancy. Mr. Gould explained that a bed &
breakfast was limited to 30 occupants and does not require the owner to reside on-site.
Chair Boothby asked for the Planning Officer's report. Mr. Gould noted that the City's
Comprehensive Plan identifies the area for high-density residential use, however, the existing
land use in this area is greatly varied, so the Planning office has no concerns with this request.
Member Durgin moved to recommend the City Council approve the rezoning request.
Member Brush seconded the motion. The Board voted unanimously to recommend the Council
approve the requested zone change from URD -2 to M&SD contained in C.O. 18-394.
