While many businesses exist on upper floors, in most cases the entry to these spaces is on the ground floor, so the current regulations are generally reasonable and appropriate for the downtown. City staff was recently contacted by the Bangor Arts Exchange regarding difficulties their patrons have experienced in finding their performance space. Because they have a very limited first floor presence (essentially an elevator lobby), which is flanked by businesses with projecting "shingle -style" signs, they are concerned that traditional signage will not be effective in helping patrons locate their space. They would like the ability to install a larger projecting sign that extends to the upper floors where their performance space is located. Historic photos of Bangor show theaters and other similar places of assembly with signs such as these. In other communities with strong entertainment districts, these types of signs are allowed. A larger, more prominent sign may be appropriate for a community -oriented use that draws a large number of people, many of whom may not be familiar with our community. To that end, staff has prepared language for addition to the sign code expressly allowing vertical projecting signs for cultural places of assembly. Committee Action Committee: Business and Economic Development Action: Staff Comments & Approvals Meeting Date: September 4, 2018 For: City Manager City olicitor Introduced for: First Reading Against: Finance Director CITY COUNCIL ORDINANCE Date: September 10, 2018 Assigned to Councilor: Tremble 18-356 09/10/2018 ORDINANCE, Amending Chapter 260, Signs, by Allowing Vertical Projecting Signs for Cultural Places of Assembly in the Downtown Development District WHEREAS, at present, projecting signs are permitted, but are extremely limited in size, and are not permitted to extend above the first story of a building; WHEREAS, community -oriented cultural places of assembly, and their patrons, could benefit from projecting signage that extends above the first story; and WHEREAS, this type of signage is traditional and common for these kinds of places of assembly; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT Chapter 260 of the Code of the City of Bangor is amended as follows: § 260-1 Definitions. PLACE OF ASSEMBLY Any building or portion thereof primarily used for gathering together persons for participation in or enjoyment of visual, literary, or performing arts, when such building or portion thereof has a capacity of 50 persons or more and has an area available for use by the occupants for assembly_ purposes of 500 square feet or more. § 260-7 District -specific standards and limitations. On -premises signs must meet the standards and limitations of the zoning district in which they are located as laid out herein. D. DDD. Every on -premises sign that requires a sign permit shall comply with the following regulations: () Projecting signs. 18-356 09/10/2018 Lal Horizontal projecting signs. WL11 Each business shall be permitted one horizontal projecting sign facing on each public right- of-way or public parking area on which it fronts or has a public entrance. f43)L2J Maximum height: three feet. fe)M Projecting signs shall protrude no more than five feet from the building surface and shall be a minimum of eight feet above the sidewalk surface. fd)M Horizontal projecting signs shall not be located above the second -floor windowsill. Vertical Projecting Signs Ll Vertical projecting signs shall only be allowed to advertise educational or cultural places of assembly, including but not limited to performing arts centers, theaters, concert halls, museums, or the buildings containing those uses. 1-21 Each building shall be permitted one vertical projecting sign facing on each public right-of- way or public parking area on which it fronts or has a public entrance. A single vertical projecting sign may be located at the corner of a building which has frontage on two streets, in place of an individual sign on each frontage. 1-31 Maximum sign area: 1 square foot for every linear foot of building frontage, not to exceed 80 square feet. Sign area is calculated as only one face of the sign. 1-41 Maximum height: 5 feet per story, not to exceed 20 feet. 1-51 Maximum width: 4 feet. 1-61 Projection: Sign face shall be a minimum of 1 foot from the building fagade. Sign shall project no more than five feet from the building surface, and no closer to the vertical plane of the curbline than two feet. M Minimum height above sidewalk: 8 feet. M Vertical projecting signs may not extend above the windowsills of the fourth stor rte. 1-91 Vertical projecting signs shall not extend above the roofline or eaves of a building, except on one-story buildings, where they shall not extend above the roofline more than 2 feet.
