Item/Subject: Directing City Engineer to Vacate a
Portion of Spaulding Street

Commentary:
The City Council has previously agreed to construct
a cul-de-sac at the
end of Bailey Street, and the existing dedicated
right-ofway of Spaulding
Street lying southeasterly of Hailey Street will
serve no public purpose.
This Council Order should be passed, and the City Engineer x111 file a
subsequent report describing the results of a public
hearing and the damages
to be paid, if any.

TUT, WHEBSAS, Spaulding Street between Westland Street and Bailey Street
fl laid out as a public way in October of 1948 as part of an approved subdivision;
and
WHEREAS, said subdivision plan also flbowe an extension of Spaulding Street
southeasterly from Bailey Street for an additional distance of approximately 173
feet, said extension never having been accepted as a public way; and
WHEREAS, said portion of Spaulding Streets serves
no public interest, and
the abutting property owners have requested that it be discontinued;
NOW, THEREFORE, Be It
ORDERED. THAT the City Engineer, acting for end on behalf of the Municipal
Officers. proceed to vacate said portion of Spaulding Street lying southeasterly
Of the southeasterly right-of-way line of Bailey Street in accordance with the
provisions of 23 M.R.S.A., 4 3027; and be It further
ORDERED, TDAT the City Engineer proceed to give best practical notice to
all abutting property owners and the planning Board; and the City Engineer is
further
ORDERED, To make a written return of said action containing the bounds
and adneasurements of said portionof Spaulding Street to be vacated. together
with a list of the abutting property owners and the amount of damages, if any,
to be paid a result of said vacation,s all in accordance with the Lawof the
State Of Maine.
