Smaha for a 90 -day period which expires m June 14th and the developer has requested a 30 -day extension (se attached letter). Rhe reasons for the requestea extension a unclear to me and discussions with the developers attorney, Andrew Hamilton, have left Matt Nichols and me with the impression that Mr. Smaha is no longer interested in developing the parcels and wants the thirty day, ettenaim to provide time to work out an arrangement to transfer his tentative developer status to other developers. W. Hamilton has been told that transfer of tentative developer status is not poszib and that any interested new developer would have to submit a Proposal directly to the City which would be treated as a new proposal. The availability of these two parcels (see attached plan) for development is somewhat clouded in that Gridley and Frazier Streets which red through the center of the parcels have never been discontinued by the City Council because aP opposition from representatives oP St. John's Church. The Church maintains they need at least one of these streets for access to the heeating oil fill pipe located at there , southeast comer of the Church (se attached property acquisition step showing location of Church and Frasier and Gridley Streets). W. Smeha and his representa- tives were informed that the City had no interest in maintaining Gridley and Frazier Streets as public ways end that any new development would require granting the Churn access to the rear a the Church. Smaha as tentative developer of Parcels designated as H-2 and H-3 in the Hancock -York Redevelopment Plan for a period of ninety (90) days, during which time the Legal Department, in consultation with the Community Development Committee and the Director of Planning and Community Development, as authorized to negotiate an option agreement with Mr. Smaha for future consideration by the City Council; and WHEREAS, the tentative developer status expires on June 14, 1988 and Albert H. Smaha has requested an extension of thirty (30) days "so that he can complete discussions with interested parties regarding execution of an option on the parcels by and between the City of Bangor and the undersigned' (Albert H. Smaha). NOW, THEREFORE, by the City Council of the City of Bangor: ORDERED, THAT the tentative developer status granted Albert H. Smaha is hereby extended to July 14, 1988. My is that the tentative developer status of Mr. Smaha nm be extended as requested because of the co¢8lictiog reports regarding his interest in undertaking the development and that before any furtherproposals are accepted, the City once again initiate action to discontinue Frazier and Gridley Streets as public ways, resolve the concerns of St. John's Church regarding the discontinuance, discontinue the streets and then advertise for development proposals. o,IyL Janne - Mem enam:e rwwd, amt, 84-2I] RODNEY G. Smaha as tentative developer of parcels designated as H-2 and H-3 in the Hancock -York Neighborhood Development Project for a period of 90 days during which time the City and your client are to negotiate an Option Agreement for sale and redevelopment of these parcels. This designation will expire on June 14, 1988, the day after the City Council meeting scheduled for .lune 13, 1988, which is the last date an option can be Considered by the Council unless an extention is granted. An attested Copy of Council Order 88-147 is enclosed for your information. Also enclosed is a copy of the form Option Agreement the City uses regarding development parcels. Please review it and obtain from your client the infonn:,tion relating to his specific project which needs to be inserted in the Option Agreement. if you have any questions or problems with the agreement, please feel free to contact either me or Matt Nichols, Asst. City Solicitor. I appreciate your contacting representatives of the St, John's Church to discuss your client's proposal. The Church's concerns regarding your client's proposed development will no doubt be a major factor in the City Council's consideration of an Option Agree- rent.
